Users may also opt out of certain advertising features through applicable device settings, such as the device advertising settings for mobile phones or ads settings in general.
Comsale Pty Ltd (trading as JW Computers Online) is bound by the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs") contained in Schedule 1 of the Privacy Act.
This section supplements the general privacy policy above and is specifically intended for users located in Australia. In the event of any inconsistency between this section and the general policy, this section will apply to Australian users.
1. The Australian Privacy Principles (APPs)
The APPs regulate how we collect, hold, use, and disclose your personal information. A summary of how we comply with each relevant APP is set out below.
APP 1 - Open and transparent management: We maintain this privacy policy and make it freely available at jw.com.au/privacy. It is reviewed periodically to reflect changes in our practices.
APP 2 - Anonymity and pseudonymity: Where lawful and practicable, you may interact with us anonymously or using a pseudonym (for example, when browsing our website without creating an account). Account registration and purchases require identification.
APP 3 - Collection of solicited personal information: We only collect personal information that is reasonably necessary for our business functions or activities, as described in the "Personal Data We Collect" section above. We collect personal information directly from you wherever practicable.
APP 4 - Unsolicited personal information: If we receive personal information we did not solicit and could not have collected under APP 3, we will destroy or de-identify that information as soon as practicable.
APP 5 - Notification of collection: At or before the time of collection (or as soon as reasonably practicable after), we notify you of the purposes for which we collect your information, as described in this policy.
APP 6 - Use and disclosure: We use and disclose your personal information only for the primary purpose of collection, or for a related secondary purpose you would reasonably expect, or where you have consented. See "Purposes of Processing" above.
APP 7 - Direct marketing: We may use your personal information for direct marketing (including email, SMS, and targeted advertising) where you have consented, or where we collected your information in the course of a transaction and you have not opted out. You may opt out at any time. See "Opting Out of Direct Marketing" below.
APP 8 - Cross-border disclosure: We disclose personal information to third-party service providers located outside Australia (see "Third-Party Data Processors" above). Before doing so, we take reasonable steps to ensure those recipients comply with privacy standards substantially similar to the APPs, or we obtain your consent, or another APP 8 exception applies.
APP 9 - Government identifiers: We do not collect, use, or disclose Australian Government identifiers (such as tax file numbers or Medicare numbers) as personal identifiers, unless required by law.
APP 10 - Quality of personal information: We take reasonable steps to ensure the personal information we collect, use, and disclose is accurate, up-to-date, and complete.
APP 11 - Security of personal information: We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. See "Security" below.
APP 12 - Access to personal information: You have the right to request access to the personal information we hold about you. See "Your Rights" below.
APP 13 - Correction of personal information: You have the right to request correction of inaccurate, out-of-date, incomplete, irrelevant, or misleading personal information. See "Your Rights" below.
2. Cross-Border Disclosure of Personal Information (APP 8)
We disclose personal information to third-party service providers located outside Australia, including in the United States, Netherlands, France, Germany, Sweden, and other countries (refer to the "Third-Party Data Processors" table in this policy for a full list).
Under APP 8, before disclosing personal information to an overseas recipient, we are required to take reasonable steps to ensure the recipient does not breach the APPs. We do this by:
- Entering into data processing agreements with recipients that require compliance with privacy standards equivalent to the APPs; and/or
- Relying on recipients that are subject to equivalent privacy frameworks (e.g., EU GDPR, which imposes comparable or greater obligations); and/or
- Obtaining your consent to the overseas disclosure.
Please note: If we disclose your personal information to an overseas recipient and you consent to that disclosure (or the disclosure is required by law), we may not be accountable under the Privacy Act for how that recipient handles your information. However, we endeavour to work only with reputable service providers who maintain high privacy standards.

We will process your opt-out request within a reasonable timeframe. Please note that transactional communications (such as order confirmations, shipping notifications, and service-related messages) are not marketing communications and cannot be opted out of while you are a customer.
4. Security of Personal Information (APP 11)

Misuse, interference, and loss
Unauthorised access, modification, or disclosure
Our security measures include (but are not limited to):
- Encrypted transmission of data (HTTPS/TLS)

When personal information is no longer required for any purpose, we will take reasonable steps to destroy or de-identify it.
5. Notifiable Data Breaches (NDB Scheme)
We are subject to the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act. If we become aware of an eligible data breach (that is, a breach that is likely to result in serious harm to one or more individuals), we will:
1. Conduct a prompt assessment of the breach (within 30 days of becoming aware);
2. Notify the Office of the Australian Information Commissioner (OAIC) as soon as practicable; and
3. Notify the affected individual(s) directly where reasonably practicable, or otherwise publish a notification on our website.
