      2.3 Il conferimento dei dati, rispetto alle finalità di cui alla lettera sub a), b) e c) è necessario per l’accesso al sito (o parti di esso) e/o l’erogazione dei servizi richiesti. per le finalità di cui alle lettere d), e) e f), l’utilizzo dei dati è condizionato al suo consenso. l’eventuale suo rifiuto non consentirà a Zoorate di procedere con l’analisi delle sue abitudini di consumo e di informarla circa le nuove iniziative commerciali di Zoorate.

Inoltre, i soggetti o le categorie di soggetti ai quali i suoi dati personali potranno essere comunicati o che potranno venirne a conoscenza in qualità di responsabili del trattamento (se nominati) o di incaricati sono: società italiane o estere, personale incaricato della gestione amministrativa e/o tecnica dei servizi, responsabili della piattaforma informatica mediante la quale sono erogati i servizi.       Come Satispay utilizzerà le informazioni ricevute
      Satispay Limited (“Satispay”) si impegna a rispettare il Data Protection Act 1998 (“DPA”).

      Satispay, quale società di tecnologia finanziaria di diritto inglese che opera nel Regno Unito ma presta i propri servizi anche in diversi paesi dello Spazio Economico Europeo (SEE), gestirà sempre (ossia raccoglierà, archivierà e utilizzerà) i dati personali degli Utenti/Commercianti in conformità con il DPA, così come recepito dalle direttive di ciascun paese, in modo corretto e lecito.

      Satispay si prefigge l’obiettivo di raccogliere dati e informazioni in modo accurato, pertinente e adeguato allo scopo per il quale tale raccolta sia resa necessaria, senza invece richiedere informazioni non necessarie.

      Che cosa si intende per policy sulla riservatezza dei dati?
      Per assicurare che i dati personali vengano gestiti in modo corretto e lecito, Satispay è tenuta ad informare l’Utente/Commerciante:

      sulle ragioni per le quali necessiti di tali dati;
      su come tali dati saranno utilizzati; e
      sul/sui soggetto/i con il/i quale/i tali dati saranno condivisi.
      Questo è lo scopo della policy di Satispay sulla riservatezza dei dati.

      Satispay è stata autorizzata dalla Financial Conduct Authority (informazioni a tal riguardo possono essere reperite al seguente link: su http://www.fsa.gov.uk/register/home.do) ad operare quale Istituto di Moneta Elettronica (“IMEL”). Le informazioni fornite a Satispay da parte dell’Utente/Commerciante possono essere anche utili al fine di individuare e prevenire le frodi o altri reati.

      Ai sensi del DPA, Satispay è titolare del trattamento dei dati personali dell’Utente/Commerciante e tali dati dovranno essere conservati in modo sicuro.

      Come vengono raccolti i dati personali da parte di Satispay?
      I dati personali che l’Utente/Commerciante comunica a Satispay provengono:

      da informazioni comunicate durante la fase di registrazione necessaria per poter accedere ai Servizi offerti;
      da informazioni comunicate telefonicamente, via email o attraverso social media; e
      dai controlli effettuati per verificarne l’accuratezza.
      Che cosa si intende per “dati personali”?
      Per “dati personali” si intendono tutte quelle informazioni utili ad identificare un soggetto, che siano già detenute da Satispay ovvero delle quali quest’ultima potrebbe entrare in possesso.

      A titolo esemplificativo, si considerano dati personali:

      nome e cognome;
      indirizzo;
      codice fiscale;
      numero di conto corrente;
      data di nascita;
      numero di telefono;
      indirizzo email.
      Che cosa si intende per “dati sensibili”?
      Nel seguito si rappresentano, a mero titolo esemplificativo e non esaustivo, quei dati personali che vengono classificati come “sensibili”:

      origine razziale ed etnica;
      stato di salute;
      vita sessuale;
      dati giudiziari (incluse eventuali condanne);
      convinzioni religiose, filosofiche o di altro genere.
      Quali sono i dati personali gestiti da Satispay?
      Satispay non gestisce dati sensibili. Tuttavia, al fine di assolvere ai propri compiti in quanto IMEL, Satispay è tenuta a richiedere dati personali quali nome e cognome, data di nascita, indirizzo, numero di telefono, email e numero di conto corrente.

      Perché Satispay deve custodire dati personali?
      Satispay ha comunicato all’Information Commissioner’s Office (ICO) che i dati personali acquisiti saranno custoditi ed utilizzati al fine di:

      fornire un servizio di trasferimento di moneta elettronica;
      prevenire e individuare reati finanziari;
      mantenere aggiornati conti e anagrafiche;
      promuovere i servizi; e
      supportare e gestire il nostro staff.
      Quali sono i soggetti i cui dati personali sono trattati da Satispay?
      Al fine di assolvere ai propri doveri quale IMEL, Satispay tratta dati personali di molteplici soggetti tra i quali, a mero titolo esemplificativo e non esaustivo, si menzionano i seguenti:

      privati;
      parenti, tutori legali e collaboratori del soggetto interessato;
      personale, ivi inclusi volontari, agenti, lavoratori occasionali, soci, lavoratori autonomi e persone che lavorano sotto contratto a nome di Satispay;
      fornitori;
      soggetti che presentino reclami, corrispondenti e soggetti che eseguono indagini;vsoggetti che presentino reclami, corrispondenti e soggetti che eseguono indagini;
      personale (ivi inclusi soggetti che abbiano ricoperto o che possano ricoprire tali incarichi), pensionati e beneficiari;
      imprese o altri contatti.
      Con chi vengono condivisi i dati personali?
      Satispay ottiene e condivide dati personali da e con diversi soggetti tra i quali si menzionano, a mero titolo esemplificativo e non esaustivo, i seguenti:

      gli stessi soggetti privati ai quali i dati si riferiscono;
      parenti, tutori legale e collaboratori del soggetto interessato;
      Ombudsman e altre Autorità di Vigilanza;
      Autorità competenti al rilascio di licenze;
      intermediari finanziari (a titolo esemplificativo, banche);
      forze dell’ordine (a titolo esemplificativo, polizia);
      responsabili del trattamento di dati personali che operano per conto di Satispay.
      Potrebbe essere necessario trasferire all’estero informazioni personali. Qualora ciò si rendesse necessario, le informazioni saranno condivise solo all’interno dello Spazio Economico Europeo (SEE). Ogni trasferimento avverrà in conformità al DPA.

      Perché Satispay deve condividere le informazioni raccolte?
      La condivisione delle informazioni raccolte può dipendere da:

      obblighi di legge;
      decisioni giudiziali;
      ragioni tese a garantire la sicurezza dei dati;
      consenso alla divulgazione prestato dall’Utente/Commerciante.
      Resta inteso che qualsiasi divulgazione di dati personali viene eseguita considerando nello specifico caso di specie. Tali dati devono sempre essere divulgati in piena sicurezza, in modo efficiente e nel rispetto delle finalità per le quali sia richiesta la diffusione.

      Le informazioni in possesso di Satispay saranno condivise solo con i soggetti che abbiano effettiva necessità di conoscerle.

      I dati personali comunicati a Satispay non sono utilizzati per ragioni legate alle vendite o al marketing da parte di soggetti diversi da Satispay o da società del gruppo. Satispay non trasferisce a soggetti terzi informazioni relative all’Utente/Commerciante salvo che questi ultimi abbiano espresso il proprio consenso a tal fine o che ciò sia richiesto dalla legge (a titolo esemplificativo, per ragioni legate alla prevenzione di frodi o altri reati).

      In qualsiasi momento l’Utente/Commerciante può comunicare a Satispay di interrompere l’utilizzo dei propri dati personali per finalità commerciali.

      Come fa Satispay a garantire la sicurezza dei dati personali?
      Satispay presta estrema attenzione alla sicurezza dei dati personali dell’Utente/Commerciante. A tale fine, ha predisposto apposite procedure per la sicurezza dei dati nonché una policy sulla sicurezza dell’informazione che consentono di proteggere i dati da perdite accidentali o da un uso improprio. Satispay permette l’accesso alle informazioni solo in presenza di un legittimo motivo.

      Che cosa accade qualora i dati in possesso di Satispay si rivelino inesatti?
      E’ importante che i dati in possesso di Satispay siano accurati e aggiornati. Qualora i dati forniti a Satispay subiscano delle modifiche è necessario che queste ultime siano comunicate prontamente all’indirizzo email support@satispay.com o attraverso i social media, così da consentire a Satispay di aggiornare le proprie anagrafiche.

      Per quanto tempo Satispay conserva i dati?
      In alcuni casi la durata di conservazione dei dati è stabilità per legge. Tuttavia, nella maggior parte dei casi, è direttamente Satispay a stabilirne la durata, che non eccede comunque il tempo richiesto per la normale erogazione dei Servizi.

      Sarà dunque cura di Satispay rimuovere in modo sicuro tali dati dai propri sistemi informatici non appena saranno diventati non più necessari.

      È possibile per l’Utente/Commerciante sapere quali informazioni Satispay detenga sul proprio conto?
      L’Utente/Commerciante può inviare per iscritto a Satispay una richiesta di accesso ai dati specificando in modo chiaro quali siano le informazioni desiderate.

      Tutte le richieste di accesso ai dati richiedono l’identificazione del richiedente e il pagamento di una commissione pari a 10 £ (dieci sterline, importo massimo che Satispay può richiedere per tale attività) da versare a Satispay. Entro 30 giorni dalla ricezione della richiesta, Satispay invierà la propria risposta.

      L’Utente/Commerciante ha il diritto di modificare, integrare o richiedere la cancellazione delle informazioni raccolte da Satispay.

      L’Utente/Commerciante ha diritto di accedere a tutte le informazioni detenute da Satispay?
      Le richieste di accesso ai dati sono soggette ad alcune limitazioni previste dal DPA.

      In alcuni casi limitati Satispay potrebbe infatti dover oscurare nomi o rifiutare di dare informazioni quando le stesse si riferiscono:

      a un terzo o siano state fornite in via riservata/confidenziale;
      alla prevenzione e alla scoperta di frodi;
      al procedimento o alla cattura nei confronti dei colpevoli;
      all’accertamento e alla riscossione di imposte e tasse;
      alle modalità attraverso le quali si prevengono o rilevano le frodi;
      alla salute e alla sicurezza del personale;
      a pareri medici la cui divulgazione potrebbe causare situazioni di disagio o comportare danni gravi.
      Satispay cercherà comunque di fornire ai richiedenti quante più informazioni possibili.
