3. TRANSPARENCY/NOTICE—TYPES OF PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT
The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with Back4App and the requirements of applicable law. Some of the ways that Back4App may collect Personal Information include:
• You may provide Personal Information directly to Back4App through interacting with the Services, participating in surveys, during events such as sweepstakes, and requesting Services, or information.
• As you navigate the Services, certain passive information may also be collected about your visit, including through cookies and similar technologies as described below.
We endeavor to collect only that information which is relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.
3.1 TYPES OF PERSONAL INFORMATION WE COLLECT
Back4App collects Personal Information regarding its current, prospective, and former Account holders or Users, non-Account holders, visitors, and guests, (collectively “Individuals”). Our primary goals in collecting information are to provide and improve our Services, to administer your use of the Services (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services.
• Information You Provide Directly to Us. When you use the Services or engage in certain activities, such as registering for an Account with Back4App, responding to surveys, requesting Services or information, submitting an inquiry, or contacting us directly, we may ask you to provide some or all of the following types of information:
o Communications with Us. We may collect Personal Information from you such as name, email address, phone number or mailing address when you choose to request information about our Services, register for Back4App’s newsletter or a loyalty program that we may offer from time to time, request to receive customer or technical support, or otherwise communicate with us. If you purchase a Subscription, we may also collect other information from you, such as credit card number, expiration date, and billing address, which will be associated with your Account. We may also collect your gender, date of birth, and other information that is not considered Personal Information because it cannot be used by itself to identify you.
o Surveys. From time to time, we may contact you to participate in online surveys. If you do decide to participate, you may be asked to provide certain information which may include Personal Information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our products, Sites and/or services and in any manner consistent with the policies provided herein.
o Posting on the Site. Back4App may offer publicly accessible fun pages, blogs, private messages, or community forums. You should be aware that, when you disclose information about yourself on Back4App’s fun pages and blogs, or in private messages and community forums, the Site will collect the information you provide in such submissions, including any Personal Information. These communications are considered “public” and will not be subject to the privacy protections set forth herein. We may monitor such communications in order to ensure the safety of the community and, by using the communication features in
our Services, you are indicating that you agree to such monitoring. Please use
your judgment when communicating with other Account holders.
o Registration for Sweepstakes or Contests. Occasionally, Back4App may run sweepstakes and contests. We ask those who enter in the sweepstakes or contests to provide contact information (e.g., an email address). If you participate in a sweepstakes or contest, your contact information may be used to reach you about the sweepstakes or contest, and for other promotional, marketing and business purposes. All sweepstakes/contests entry forms will provide a way for participants to opt out of any communications that are not related to awarding
o Automatic Data Collection. We may collect certain information automatically
through our Services or other methods of web analysis about how a person, including a User, uses our Services (we refer to this information as “Log Data”). Log Data may include information such as your Internet protocol (IP) address, cookie identifiers, mobile carrier, mobile advertising identifiers, MAC address, IMEI, Advertiser ID, and other device identifiers that are automatically assigned to your computer or device when you access the Internet, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, the amount of time you spend on each page, information about the links you click and pages you view within the Services, search terms, the links on our Services that you clicked on, and other actions taken through use of the Services such as preferences. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize, and enhance our Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We may use a person’s IP address to generate aggregate, non-identifying information about how our Services are used.
• Information Submitted Via Services. You agree that Back4App is free to use the content of any communications submitted by you via the Services, including any ideas, inventions, concepts, techniques, or know-how disclosed therein, for any purpose including developing, manufacturing, and/or marketing goods or Services. Back4App will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) you grant us permission to do so; (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or (c) we are required to do so by law.
• Information from Other Sources. We may receive information about you from other sources, including through Third-Party services and organizations to supplement information provided by you. For example, if you access our Services through a Third- Party application, such as an App Store or SNS, we may collect information about you from that Third-Party application that you have made public via your privacy settings. Information we collect through App Stores or SNS accounts may include your name, your SNS user identification number, your SNS user name, location, sex, birth date, email, profile picture, and your contacts on the SNS. This supplemental information
allows us to verify information that you have provided to Back4App and to enhance our ability to provide you with information about our business, products, and Services.
• Location Information. When you use our Services, we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your device’s GPS coordinates or coarse location if you enable location services on your device.
HOW BACK4APP USES YOUR INFORMATION
We acquire, hold, use, and Process Personal Information about Individuals for a variety of business purposes, including:
• To Provide Products, Services, or Information Requested. Back4App may use information about you to fulfill requests for products, Services, or information, including information about potential or future Services, including to:
o Generally manage Individual information and Accounts;
o Respond to questions, comments, and other requests;
o Provide access to certain areas, functionalities, and features of Back4App’s
o Contact you to answer requests for customer support or technical support; o Allow you to register for events.
• Administrative Purposes. Back4App may use Personal Information about you for its administrative purposes, including to:

o Ensure internal quality control;
o Verify Individual identity;

• Research and Development. Back4App may use Personal Information to create non- identifiable information that we may use alone or in the aggregate with information obtained from other sources, in order to help us to optimally deliver our existing products and Services or develop new products and Services. From time to time, Back4App may perform research (online and offline) via surveys. We may engage Third-Party service providers to conduct such surveys on our behalf. All survey responses are voluntary, and the information collected will be used for research and reporting purposes to help us better serve Individuals by learning more about their needs and the quality of the products and services we provide. The survey responses may be utilized to determine the effectiveness of our Services, various types of communications, advertising campaigns, and/or promotional activities. If an Individual participates in a survey, the information given will be used along with that of other study participants. We may share anonymous Individual and aggregate data for industry research and analysis, demographic profiling, and other similar purposes.
• Direct Mail, Email and Outbound Telemarketing. Individuals who provide us with Personal Information, or whose Personal Information we obtain from Third Parties, may receive periodic emails, newsletters, mailings, or phone calls from us with information on Back4App’s or our business partners’ products and Services or upcoming special offers/events we believe may be of interest. We offer the option to decline these communications at no cost to the Individual by following the instructions in Section 5 below.
• Services via Mobile Devices. From time to time, Back4App may provide Services that are specifically designed to be compatible and used on mobile devices. Back4App will collect certain information that your mobile device sends when you use such Services, like a device identifier, user settings, location information, mobile carrier, and the operating system of your device. Mobile versions of Back4App’s Services may require that users log in with an Account. In such cases, information about use of mobile versions of the Services may be associated with Accounts. In addition, Back4App may enable Individuals to download an application, widget, or other tool that can be used on mobile or other computing devices. Some of these tools may store information on mobile or other devices. These tools may transmit Personal Information to Back4App to enable Individuals to access Accounts and to enable Back4App to track use of these tools. Some of these tools may enable users to email reports and other information from the tool. • Anonymous and Aggregated Information Use. Back4App may use Personal Information and other information about you to create anonymized and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access Back4App’s Services, or other analyses we create. Anonymized and aggregated information is used for a variety of functions, including the measurement of visitors’ interest in and use of various portions or features of the Services. Anonymized or aggregated information is not Personal Information, and Back4App may use such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. Sharing Content with Friends or Colleagues. Back4App’s Services may offer various tools and functionalities. For example, Back4App allows you to provide information about your friends through our referral services, such as “Tell a Friend.” Our referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use our Services. Email addresses that you may provide for a friend or colleague will be used to send your friend or colleague the content or link you request, but will not be collected or otherwise used by Back4App or any other Third Parties for any other purpose.

Back4App’s Services may include publicly accessible blogs, community forums, or private messaging features. The Site and our other Services may also contain links and interactive features with various social media platforms (e.g., widgets). If you already use these platforms, their cookies may be set on your device when using our Site or other Services. You should be aware that Personal Information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform or otherwise online, or that you share in an open forum may be viewed and used by others without any restrictions. We are unable to control such uses of your information when interacting with a social media platform, and by using such services you assume the risk that the Personal Information provided by you may be viewed and used by third parties for any number of purposes.
4. ONWARD TRANSFER—BACK4APP MAY DISCLOSE YOUR INFORMATION
4.1 INFORMATION WE SHARE
• We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers. The types of service providers to whom we entrust Personal Information include service providers for: (i) provision of IT and related services; (ii) provision of information and services you have requested; (iii) payment processing; (iv) customer service activities; and (v) in connection with the provision of
the Site. Back4App has executed appropriate contracts with the service providers that prohibit them from using or sharing Personal Information except as necessary to perform the contracted services on our behalf or to comply with applicable legal requirements.
• Business Partners. Back4App may share Personal Information with our business partners, and affiliates for our and our affiliates’ internal business purposes or to provide you with a product or service that you have requested. Back4App may also provide Personal Information to business partners with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you. • Displaying to Other Users. The content you post to the Site may be displayed on the Site. You agree that all Personal Information collected via or by Back4App may be transferred, Processed, and stored anywhere in the world, including but not limited to, the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. Your Personal Information may be accessible to law enforcement or other authorities pursuant to a lawful request. By providing information to Back4App, you explicitly consent to the storage of your Personal Information in these locations.
5. OPT-OUT (RIGHT TO OBJECT TO PROCESSING)
You have the right to object to and opt out of certain uses and disclosures of your Personal Information. Where you have consented to Back4App’s Processing of your Personal Information or Sensitive Personal Information, you may withdraw that consent at any time and opt out of further Processing by contacting email@example.com. With regard to Personal Information that Back4App receives in connection with the employment relationship, Back4Appwill use such Personal Information only for employment-related purposes as more fully described above. If Back4App intends to use this Personal Information for any other purpose, Back4App will notify the Individual and provide an opportunity to opt out of such uses.
5.5 “DO NOT TRACK”
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Although Back4App makes good faith efforts to provide Individuals with access to their Personal Information, there may be circumstances in which Back4App is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If Back4App determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. • “Employee” refers to any current, temporary, permanent, prospective or former employee, director, contractor, worker, or retiree of Back4App or its subsidiaries worldwide.
• “Personal Information” is any information relating to an identified or identifiable natural person (“Individual”).
• “Process” or “Processing” means any operation which is performed upon Personal Information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
• “Sensitive Data” or “Sensitive Personal Information” is a subset of Personal Information which, due to its nature, has been classified by law or by policy as deserving additional privacy and security protections. Third-Party Service Integration
To use Zapier, we need to store credentials for third-party services (Gmail, Basecamp, etc). We store credentials encrypted in our database. They are only used to access data you tell us to. We log certain non-identifiable information to provide support and fix problems.
Our Service allows you to integrate and create commands for various online third-party services ("Third-Party Services"). In order to take advantage of this feature, you may need to authenticate, register for or log into Third-Party Services through the Service or on the websites of their respective providers. When you enable linking between or log in to Third-Party Services through the Service, we will collect relevant information necessary to enable the Service to access that Third-Party Service and your data and content contained within that Third-Party Service ("Login Credentials"). We store your Login Credentials long enough to enable linking to the Third-Party Service.

To protect customer privacy and security, we reserve the right to take reasonable steps to verify a customer's identity prior to granting access to or processing changes or corrections to such information. How We Use Personal Information
Requests for Information. If you provided your email address or phone number on the Sites to receive information from Marketing Mavens, you agree that Marketing Mavens, and our fulfillment partners may contact you using the contact information you provide us regarding our products and Services, such as offers, support and product updates. Marketing Mavens and our fulfillment partners may make such contact by email, phone and/or text, including the phone number you provide us, and we may use automated dialers technology in order to more efficiently connect you with one of our representatives. Your mobile phone carrier’s standard message and data rates may apply to text messages. You are not required to provide your phone number as a condition of purchasing products or Services, and you can opt out at any time as described in the “Opting Out” section found below within this Policy.
Email. We may communicate with a customer through email using the customer's personal contact information on file in our systems to inform the customer of new products, important industry news or information about Services and upgrades provided by Marketing Mavens.
Disclosures to Third Parties - General. We may disclose information collected from a customer to our independent contractors and business partners who have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except to carry out the services they are providing for Marketing Mavens. Such contractors and business partners include those hosting our Services or other data; managing the functionality of our Services; hosting customer relationship management, marketing automation, customer service and other software platforms on our behalf; processing credit or other payment card payments; collecting delinquent accounts; fulfilling and processing orders; delivering products you have ordered; conducting background checks if you submit an application for employment; assisting with marketing and promotions; and enabling us to send you email.
Disclosures to Third Parties - Specific. Marketing Mavens has a number of partner programs designed to maximize our customers' ability to use our Services and to purchase complementary products and services that may be used in tandem with our Services. We may disclose information collected from a customer to one or more trusted partners for the purpose of such partner(s) providing assistance to the customer in its use of the Services and for the purpose of marketing complementary or value-add products and services to the Customer. In each case such trusted partner will have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except for the purposes described above.
Disclosures of Aggregate Information. Marketing Mavens may also disclose aggregate, anonymous data based on information collected from customers. Should a sale of Marketing Mavens's business ever occur, collected customer information may be transferred along with the sale but the information will be treated in the same manner as set forth in this Policy. In the event of any significant changes to the manner in which your information is handled, we would notify you by a prominent notice on the Sites, or by email.
Disclosures Made by You within Interactive Areas of a Site. WHAT PERSONAL DATA DOES FRESHWORKS COLLECT AND WHY?
A) Personal Data we collect and process for our own purposes: Collected Data
When you visit our Websites or participate in Freshworks’s events, Freshworks may collect information, which may include Personal Data, from Individuals as set forth below (collectively referred to as “Collected Data”). For the purposes of General Data Protection Regulation (GDPR), Freshworks shall be the controller for the Collected Data – this means that Freshworks decides what Collected Data is processed and why.
When does Freshworks process Collected Data?
1) Sign-up, billing and Account information.
When you subscribe and sign-up to any of our Service(s), we may collect your (i) contact information such as name, e-mail address, mailing address, IP address, geographic location, or phone number of the Account admin; (ii) billing information, such as credit card number and billing address; (iii) name and e-mail address when Account admin/Agent(s) provide feedback from within the Service(s); and (iv) unique identifiers, such as username, account number or password.
Subject to this Notice and the Terms, we will use such data, including without limitation, to (i) provide you the Service(s); (ii) send you communication from the Service(s); (iii) assess needs of your business to determine or suggest suitable Service(s); (iv) send you requested information about the Service(s); (v) respond to customer service requests, questions and concerns; (vi) administer your Account; (vii) send you promotional and marketing communications (where you have requested us to do so); and (viii) facilitate your transactions with other users when you use our Service(s).
2) Freshworks Careers.
When you apply for an open position by populating the application form, we may collect your (i) contact information, such as name, email address, mailing address, phone number, links to your social networking profiles; and (ii) any other information contained in the resume that you submit to us.
Subject to this Notice, we will use such data to evaluate you for the open position that you have applied for or any position that we consider you suitable for at the time you submit your resume or at any later date. Unless you notify us otherwise by an e-mail to firstname.lastname@example.org, we will retain such data for a period of 1 year for archival purposes. If you wish to update the data you provided to us, you may do so by contacting us at email@example.com.
For the purposes of evaluating you for an open position, you understand that we may internally rate you based on parsing of your resume and your information. If you do not wish to be rated by us, please do not provide us your information.
When you attend an event conducted by Freshworks, including webinars or seminars, we may collect your contact information such as name, e-mail address, designation and company name.
Subject to this Notice, we will use such data, including without limitation, to (i) assess needs of your business to determine or suggest suitable Service(s); (ii) send you requested information about the Service(s); (iii) send you promotional and marketing communications (where you have requested us to do so); and (iv) respond to your questions and concerns.
4) Referrals via Glowboard.
To help refer our Service, Customers can provide us with contacts within the Service. We may collect contact information such as name, e-mail address, mailing address, or phone number of such contact from our Customer. By providing us this information about third parties, you warrant you have complied with all necessary legal requirements to provide us with this information, including obtaining all necessary consents and providing the third party with a copy of this Notice.
If you have been referred by our Customer, then, subject to this Notice, we will use such data, including without limitation, to (i) assess needs of your business to determine or suggest suitable Service(s); (ii) send you promotional and marketing communications (where you have requested us to do so); and (iii) respond to your questions and concerns.
5) Program Registrations.
When you register for any of our programs through a registration form on our Websites, we may collect information such as name, e-mail address, company name and website URL, company details, location and contact information. Subject to this Notice, we will use such data, including without limitation, to (i) facilitate your use of the program portal for which you have registered; (ii) send you communication from within the Service(s); (iii) send you requested information about our Service(s); (iv) respond to your requests, questions and concerns; and (v) send you promotional and marketing communications (where you have requested us to do so).
6) Public forums and Newsletters.
When you visit our publicly accessible community forums and blogs, you should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Further, we may collect your (i) contact information such as name, e-mail address, mailing address, or phone number; (ii) information about your business, such as company name, company size, business type; and (iii) a short bio about you to identify you as the author of the post. When you actively subscribe to our newsletters, we collect your e-mail address to share our newsletters with you.
Subject to this Notice, we will use such data, including without limitation, to (i) assess needs of your business to determine or suggest suitable Service(s); (ii) send you requested information about the Service(s); (iii) send you promotional and marketing communications (where you have requested us to do so); and (iv) respond to your questions and concerns.
7) Clear Gifs and Log Files.
We and our third party advertising partners use technologies such as web beacons in analyzing trends, administering the website, tracking users’ movements around the site, and gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.
As is true of most websites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We link this automatically collected data to other data we collect about you.
Apart from the aforementioned information collected by us, we automatically receive and record certain Personal Data of yours when You visit our Websites. This includes device model, IP address, the type of browser being used, usage pattern through cookies and browser settings, query logs and product usage logs. We also collect clicks, scrolls, conversion and drop-off on our Websites and Service(s) to render user journey at real-time. Subject to this Notice, we will use such data, including without limitation, to (i) assess needs of your business to determine or suggest suitable Service(s); (ii) send you requested information about the Service(s); (iii) respond to customer service requests, questions and concerns; and (iv) for analytical purposes.
You authorize Freshworks and its service providers to perform analytics on such Collected Data, to (i) improve, enhance, support and operate the Websites; and (ii) compile statistical reports and record insights into usage patterns. You acknowledge that Freshworks uses Collected Data, as the case may be, for the aforementioned purposes.
We may post your testimonials/comments/reviews on our Websites which may contain your Personal Data. Prior to posting the testimonial, we will obtain your consent to post your name along with the testimonial. If you want your testimonial removed, please contact us at firstname.lastname@example.org.
You understand that we will not be liable to any person for unauthorized publishing of testimonials by customers of Glowboard. If you, as a Customer of our Service Glowboard, wish to publish on your websites, any testimonials you have received from third parties via e-mails or widgets, it is your responsibility to obtain consent from such third parties prior to publishing the testimonials.
10) Marketing communications.
We may use your e-mail address, collected as part of Collected Data, to send our newsletters and/or marketing communications about our products and services. Where you have so requested, we will also send you marketing communications about our third party partners. If you no longer wish to receive these communications, you can opt out by following the instructions contained in the e-mails you receive or by contacting us at email@example.com.
What is our legal basis for processing Personal Data (EEA visitors only)?
If you are a visitor from the European Economic Area, our legal basis for collecting and using the Personal Data described above will depend on the Personal Data concerned and the specific context in which we collect it.
However, we will normally collect Personal Data from you only where we need the Personal Data to perform a contract with you, or where the processing is in our legitimate interests or rely upon your consent where we are legally required to do so and not overridden by your data protection interests or fundamental rights and freedoms. B) Data we process on your behalf: Service Data
We only process Service Data as per our Customer's instructions. For purposes of the GDPR and the Swiss Federal Act on Data Protection, we are the processor and not the controller of the Service Data. Service Data, as defined in the Terms, means all electronic data, text, messages or other materials, including Personal Data of Users and End-Users, submitted to the Service(s) by our Customers through Customer’s Account in connection with Customer’s use of the Service(s), including data collected under “Other Information” and “Mobile Applications” below. Our EEA or Switzerland based Customers are the “controllers” of that data and are responsible for compliance with the applicable data protection law. We work with our Customers to help them provide notice to their customers concerning the purpose for which Personal Data is processed by Freshworks.
If you are our Customer from EEA or Switzerland, then in your role as a controller, you are authorizing, on behalf of you and your authorized agents and End-Users, and representing that you have the authority to provide such authorization to the processing and transfer of Personal Data in and to the United States and other countries which may have different privacy laws from your or their country of residence. We will take all steps reasonably necessary to ensure that the Service Data is treated securely and in accordance with this Notice.
We do not own, control or direct the use of Service Data, and in fact we are largely unaware of what information is being stored on our platform and only access such information as reasonably necessary to provide the Service(s) (including to respond to support requests), as otherwise authorized by Customers or as required by law. Unless we explicitly agree otherwise in writing, you will not process sensitive personal data (such as health data) on our platform.
As the controller, it shall be your responsibility to inform the End-Users about the processing, and, where required, obtain necessary consent or authorization for any Personal Data that is collected as part of the Service Data through your use of the Service(s). As the processors of Personal Data on behalf of our Customers, we follow Customer’s instructions with respect to the Service Data to the extent consistent with the functionality of our Service(s). In doing so, we implement technical, physical and administrative measures against unauthorized processing of such information and against loss, destruction of, or damage to, Personal Data.
Where an User or End-User uses the Service(s), we automatically receive and record certain information of such user. This information includes device model, IP address, the type of browser being used, usage pattern through cookies and browser settings, query logs and product usage logs (collectively referred to as “Other Information”). If you are a customer of Freshchat, please note that you will have the option to opt out of tracking certain events from within Freshchat.
When you download, install and use our Mobile Applications, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”).
Subject to this Notice, we will use such data to (i) provide and manage Mobile Application; (ii) if you have opted in to receiving push notifications, send you push notifications from time-to-time in order to update you about any events or promotions that we may be running and/or update you about new features to our Service(s); (iii) send you promotional and marketing communications (where you have requested us to do so). If you no longer wish to receive these types of communications, you may turn them off at the device level.
Improving and enhancing our Service(s).
You expressly authorize us and the service providers we use to process the Service Data in our systems to (i) provide, improve, enhance, support and operate the Service(s) and its availability; (ii) develop new products and services; and (iii) compile statistical reports and record insights into usage patterns.
You can log in to our Websites using sign-in services such as Google, Facebook Connect and LinkedIn. These services will authenticate your identity and provide you the option to share certain Personal Data with us such as your name and e-mail address. Services like Google, Facebook Connect, Twitter, LinkedIn give you the option to post information about your activities on our Websites to your profile page and to share information with others within your network.
SOCIAL MEDIA FEATURES
Our Websites includes social media features, such as the Facebook “Like” button, the “Share This” button or interactive mini-programs. Where you interact with these features, they may collect your IP address, which page you are visiting on our Websites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Websites. SHARING OF PERSONAL DATA
Except as outlined in this Notice and the Terms, Personal Data contained in Collected Data and Service Data will never be sold to or shared with other companies or organizations for commercial purposes. We process Personal Data in the United States and the European Economic Area (“EEA”) and in other countries through third parties that we may use. You may refer to the page here for more information on hosting options. Third parties with whom Collected Data is shared may include third-party payment processors who process your credit card and other payment information for Freshworks but are otherwise not permitted to store, retain or use such information. Third parties that we utilize to assist in providing the Service(s) with whom Service Data may be shared are listed here (“Sub-Processors”). Further, we may transfer Personal Data to our Group Companies for the purposes identified in the Terms and this Notice. All such transfers are covered by the service agreements with the relevant recipients and we have taken appropriate safeguards to ensure that your Personal Data will remain protected in accordance with this Privacy Notice. Subject to the Terms and this Notice, we and our Group Companies shall have the right to access Customer’s Account and to process Service Data solely to the extent necessary to provide, enhance and improve the Service(s), including, without limitation, in response to Customer’s support requests. Our Sub-Processors will only be given access to Customer’s Account and Service Data as is reasonably necessary to provide the Service(s) and will be subject to confidentiality obligations in their service agreements.
Privacy Shield Compliance
Freshworks, Inc. participates in and has certified its compliance with the EU-U.S. and Swiss-US Privacy Shield Framework. Freshworks, Inc. is committed to subjecting all Personal Data received from European Union (EU) member countries and Switzerland, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. Freshworks, Inc. is responsible for the Personal Data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Freshworks, Inc. complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, and Switzerland including the onward transfer liability provisions. Freshworks further commits to cooperate with EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) and comply with the advice given by such authorities with regard to human resources data transferred from the EU and Switzerland in the context of the employment relationship.
With respect to Personal Data received or transferred pursuant to the Privacy Shield Framework, Freshworks, Inc. is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Freshworks, Inc. and/or its Group Companies may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

B) Service Data
If you seek access to, or wish to correct, update, modify or delete Personal Data (hereinafter referred to as a “Request”) which is part of the Service Data and processed by us on behalf of our Customer, you should direct your query to our Customer i.e, the controller. If you are a Customer of our Service(s) and wish to raise a Request on behalf of your Users and End-Users in connection with Service Data, you may raise a ticket on the support portal of the relevant Service. Please note that if a Customer has subscribed to more than one Service, a Request on a particular Service support portal is specific to that Service only and separate Requests need to be raised across other relevant Service support portals.
If you are our Customer, we will send you announcements related to the Service(s) on occasions when it is necessary to do so. For instance, if our Service(s) is temporarily suspended for maintenance, we might send you an e-mail. Generally, you may not opt-out of communications which are not promotional in nature. If you do not wish to receive them, you may deactivate your Account.
RETENTION OF PERSONAL DATA

Except as otherwise set forth below, Personal Data contained in the Service Data is retained and deleted in accordance with the Terms.
If you are a Customer of our Service Freshcaller, please note that upon a Request for deletion of a contact, information such as name of the contact, call recordings of that contact and any notes pertaining to such call recordings shall be deleted. However, information such as logs containing actual numbers making and receiving the calls may be retained for audit, fraud and reporting purposes in accordance with applicable law.
If you are a Customer of our Service Freshdesk and Freshservice, and if you have raised a Request for deletion of a User, please note that, for business continuity purposes, deleting the User does not delete business-specific organization-owned data created and contributed to by the User including without limitation, knowledgebase articles, notes, forum topics/comments, support calls, surveys, automation and dispatcher rules, canned responses, ticket templates, contacts, companies, tags, conversations in the tickets, etc. The deleted User’s Personal Data will then be anonymized within the Service.
If you are a Customer of our Service Freshteam, you may at any time delete data associated with a Candidate from within Freshteam. As a customer of Freshteam, you may delete a User’s data from Freshteam. Upon your deletion of User’s data, Freshteam will retain information like business e-mail address, identification number, designation of such User (“Retained User Information”) in order to not break any old associations relating to such User within your Account. Except Retained User Information, all the other data that you delete will be deleted from Freshteam. Retained User Information will be deleted in accordance with the Terms. If You wish to permanently delete a User’s Retained User Information, you can write to firstname.lastname@example.org.
If you are a customer of Freshchat and wish to raise a Request for deletion of an Agent, please write to email@example.com. Please note that for the purpose of business continuity, the name of the deleted Agent will be retained within your Freshchat Account.
Notwithstanding the foregoing, we will retain Collected Data and Service Data as necessary to comply with our legal obligations, for litigation/defense purposes, maintain accurate financial and other records, resolve disputes, and enforce our agreements.
LINKS TO THIRD PARTY SITES
Our Websites contain links to other websites that are not owned or controlled by Freshworks. Please be aware that we are not responsible for the privacy practices of such other websites or third parties. We encourage you to be aware when you leave our Websites and to read the privacy policies of each and every website that collects Personal Data.
CHILDREN'S PERSONAL DATA
Freshworks does not knowingly collect any Personal Data from children under the age of 16. If you are under the age of 16, please do not submit any Personal Data through our Websites or Service(s). Like most internet-service operators, REVE Chat also collects non-personally-identifying information of the sort that web browsers, apps and servers typically make available, such as the browser type, language preference, geographical location, referring site, and the date and time of each visitor request.

Credit or payment card data is used to process payments for Subscriptions to the Service.
When you interact with REVE Chat through the Service, we receive and store certain information, which is collected passively using various cookies and similar technologies, and cannot presently be used to specifically identify you.
We also engage third party providers to serve a variety of marketing cookies that track and analyse usage, navigational and other statistical information from visitors to Our Site, which does not include personal information but REVE Chat and its service providers may store such information itself or such information may be stored in databases owned and maintained by REVE Chat or its agents or service providers.

In an ongoing effort to better understand and serve our Customers, REVE Chat often conducts research on its customer demographics, interests and behaviour based on the personal and other information provided to us.
This research may be compiled and analysed on an aggregate basis, and REVE Chat may share or otherwise publish or distribute this aggregate data. This aggregate information does not identify you personally. REVE Chat may also disclose aggregated user statistics in order to describe Our Service to current and prospective business partners, customers and to other third parties for other lawful purposes.
Do Not Track Signals
We do not currently respond to web browsers’ “Do Not Track” signals that provide a method to opt out of the collection information about visitors activities on the Site and Service, and across other websites. If we do so in the future, we will provide all relevant information in this Policy.
REVE Chat currently processes personal information on its servers located in Singapore, Germany, Canada, the Netherlands and the United States of America. We may change the locations in which we process personal information from time to time, including by commencing personal information processing in additional or different Other Countries.
REVE Chat only shares personal information with other third parties outside of REVE Chat in the following limited circumstances:
We have obtained our customer’s consent.
We sometimes hire third parties to perform certain business-related functions. Examples of such functions include maintaining databases and processing payments or otherwise providing us with necessary software, networking, storage and other services we use to provide and operate the service. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our products and services.
We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary. Customers of REVE Chat may update or change the personal information they have provided to REVE Chat by logging into the Service and providing such information where applicable.
REVE Chat will retain personal information we process on behalf of our customers for as long as needed to provide the Service to our customers. We may further retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, maintain accurate accounting, financial and other operational records and enforce our agreements.
REVE Chat has not direct relationship with the individuals with whom our customers may interact using the Service. Any such individual seeking access to, or who would like to correct, amend or delete data that may be stored in the Service should direct his or her inquiry to the applicable REVE Chat customer.
REVE Chat takes reasonable steps to protect personal information collected through our service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or electronic transmission (including email) is ever fully secure or error free. 1. YOUR DATA
We collect two basic types of data on our Site: PII and aggregate data.

ScheduleOnce uses analysis cookies that collect data about how people use our Site, including which pages visitors go to most often, how fast they load, and other statistical data. These cookies do not collect data that individually identifies a visitor. All data these cookies collect is aggregated and anonymous. It is only used to tell us how our Site is used so that we can optimize our visitors’ experience.
1.4 Web beacons
Web beacons (also known as Internet tags, pixel tags, single-pixel GIFs, clear GIFs, invisible GIFs, 1-by-1 GIFs, and web bugs) are tiny graphic files placed on a web page, or in an email, that send a signal when someone visited that page or opened the email, which allow us to collect standard access data, such as time and date of a page view, and a description of the page on which the web beacon resides. We may use web beacons to help us understand how visitors use the ScheduleOnce Site and to gather access data, such as counting the number of visitors to those pages and compiling aggregated statistics about site usage. Our web beacons do not contain any PII and we would not link web beacons to your PII.
1.5 No PII about children
Our Site is not intended to be used by children under the age of 13 and we do not knowingly, directly, or passively collect PII from children under the age of 13.
2. USE OF PII
2.1 Internal use of PII
All PII and content submitted by you is stored in our database and may be archived elsewhere. Our system administrators and support personnel will have access to PII that we process. In general, we use PII internally to serve our users and enable them to take maximum advantage of the ScheduleOnce Service. For example, PII is used to resolve technical support cases, to conduct marketing analysis, to create an individual profile and provide personalized services, to provide services or complete transactions you have requested, to anticipate and resolve problems with the ScheduleOnce Service, and to create and inform you of new products and services that better meet your needs.
We may communicate with you at any of the contact points you provide to us for any of the aforementioned purposes. Please note that ScheduleOnce will never initiate contact with your customers.
2.2 Disclosure of PII
We do not rent, sell, or share PII about you with other people or non-affiliated companies except (i) as necessary to complete a transaction you have requested, (ii) as necessary to perform internal analyses, technical support, and other business functions, (iii) as part of a business transfer, or (iv) when required by law or permitted in order to protect our rights, property, or safety. The following section describes these disclosure circumstances more fully.
Consent: Unless you choose to do so, we will not disclose your PII to third parties for their direct marketing purposes. With your consent, we may disclose your PII to third parties so that they may provide you with products and services that you have requested.
Transaction processing, technical support, and other business functions: We may share PII with third-party vendors who assist us in performing technical support and other internal functions necessary to operate our business, or who assist us in processing and completing transactions that you have requested. In the event that we use third-party vendors to assist us in performing these functions, the third parties may not use or disclose your PII for any other purpose.

If the Client requests JustCall to remove the data, we will respond to its request within thirty (30) days. We will delete, amend or block access to any Personal Data that we are storing only if we receive a written request to do so from the Client who is responsible for such Personal Data, unless we have a legal right to retain such Personal Data. We reserve the right to retain a copy of such data for archiving purposes, or to defend our rights in litigation. In compliance with the Privacy Shield Principles, JustCall commits to resolve complaints about our collection or use of your personal information. How do we protect your information?
An external PCI compliant payment gateway (Stripe, Inc) handles all credit card transactions and we conduct regular vulnerability checks to prevent security issues.
Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive information you supply is encrypted using industry-standard protocols and is transmitted via TLS/SSL technology. We provide 2FA (2-factor authentication) for every account as an extra layer of security for your personal data. In case of data loss or security breaches, this helps us keep confidentiality, integrity and availability of our customers personal data.
In case of a security breach, we have the policy to do an immediate investigation of the incident and report to the competent data protection authority within 72 hours or less, and also notifying all the affected data subjects of a high-risk data breach incident.

The Service is hosted in the United States or Germany. Regardless of the database being hosted in the European Union, if you choose to use the Service from the EU or other regions of the world with laws governing data collection and use that may differ from US law, then please note that you may be transferring your Client Data and Personal Data outside of those regions to the United States for storage and processing by our service providers listed in the our Terms of Service. We will comply with GDPR requirements providing adequate protection for the transfer of personal information from Europe to the US. Data Controller and Data Processor
JustCall does not own, control or direct the use of any of the Client Data stored or processed by a Client or User via the Service. Only the Client or Users are entitled to access, retrieve and direct the use of such Client Data. JustCall is largely unaware of what Client Data is actually being stored or made available by a Client or User to the Service and does not directly access such Client Data except as authorized by the Client, or as necessary to provide Services to the Client and its Users.
The Client or the User is the data controller under the Regulation for any Client Data containing Personal Data, meaning that such party controls the manner such Personal Data is collected and used as well as the determination of the purposes and means of the processing of such Personal Data.
JustCall is not responsible for the content of the Personal Data contained in the Client Data or other information stored on its servers (or its subcontractors’ servers) at the discretion of the Client or User nor is JustCall responsible for the manner in which the Client or User collects, handles disclosure, distributes or otherwise processes such information.

5. Purchasing a Product from Us
When purchasing a product from us, we collect the following data:-

What we collect and store
