    5. Navigational Information
    5.1. Cookies
    Agile CRM and its partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole.

    We use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a Web server. Cookies are not used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a Web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize pages on our Websites, or register for the Subscription Service, a cookie helps us to recall your specific information on subsequent visits. When you return to the same Website, the information you previously provided can be retrieved, so you can easily use the customized features.

    You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Agile CRM Subscription Service or Websites you visit. Agile CRM keeps track of the Websites and pages you visit within Agile CRM, in order to determine what portion of the Agile CRM Website or Subscription Service is the most popular or most used. This data is used to deliver customized content and promotions within the Agile CRM Website and Subscription Service to customers whose behavior indicates that they are interested in a particular subject area.

    5.2. Log Files
    We may collect demographic information, such as your ZIP code, age, gender, preferences, interests and favorites using log files that are not associated with your name or other personal information. There is also information about your computer hardware and software that is automatically collected by us. This information can include: your IP address, browser type, domain names, internet service provider (ISP), the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used by Agile CRM for the operation of the Subscription Service, to maintain quality of the Subscription Service, and to provide general statistics regarding use of the Agile CRM Website. For these purposes, we do link this automatically-collected data to Personal Information such as name, email address, address, and phone number.

    5.3. Clear Gifs (Web Beacons/Web Bugs)
    We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage the Website and Subscription Service by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages or in emails and are about the size of the period at the end of this sentence. We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. We tie the information gathered by clear gifs in emails to our customers' Personal Information. If you would like to opt-out of these emails, please see "Opting Out and Unsubscribing".

    5.4. Navigational Information Collected by Our Customers
    Our customers can use the tools we provide, as well as tools provided by third parties, to collect Navigational Information when you visit their webpages on the Subscription Service. Agile CRM does not control our customers' use of these tools, nor do we control the information they collect or how they use it.

    5.5. Single Sign-On
    You can log in to our site using a Single Sign-on (SSO) service like your Google account. This service will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Such services may give you the option to post information about your activities on this Web site to your profile page to share with others within your network.

    5.6. Flash Cookies and Other Third Party Tracking Technologies
    The Adobe Flash Player (and similar applications) use technology to remember settings, preferences and usage similar to browser cookies but these are managed through a different interface than the one provided by your Web browser. This technology creates locally stored objects that are often referred to as "Flash cookies." Agile CRM does not use Flash cookies. However, our customers of our software platform may create pages on the Agile CRM platform that employ Adobe Flash cookies. Agile CRM does not have access or control over our customers' Flash cookies, but you may access your Flash management tools from Adobe's website directly here.

    Similarly, our customers may create pages using the Agile CRM Subscription Service that use technology from tracking utility companies, such as cookies and web beacons. The use of these technologies by our customers is not covered by our Privacy Policy. We do not have control over third party cookies or trackers our customers use.

    5.7. Advertising
    We partner with a third party ad network to either display advertising on our Web site or to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons to collect non-personal information about your activities on this and other Web sites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by clicking here: http://preferences.truste.com/ (or if located in the European Union, by clicking here: http://www.youronlinechoices.eu/). Please note this does not opt you out of being served advertising. You will continue to receive generic ads.

    5.8. Third Party Tracking Technologies
    The use of cookies and web beacons by any tracking utility company is not covered by our Privacy Policy.

    Our site is intended for a general audience and we do not knowingly collect personal information from anyone under the age of 13.

    How FullStory Collects Information
    Cookies are small data files placed on your computer by the websites you visit and the emails you read and can be used to help recognize you when you return to a website, or when you visit other sites. We, or third party service providers, may use cookies to, among other things, measure activity, personalize your experience, remember your viewing preferences, or track your status or progress when accessing our site. For some of these purposes, our cookies may be tied to Personal Information and/or Potential PII. In particular, the FullStory Services use first-party cookies to maintain a coherent scope for a user session across multiple pages on a single website. These cookies do not track the same user across unrelated domains and, as described above, attempts to infer identity across domains is strictly prohibited.

    Local Storage is a standard facility provided by HTML5-compliant browsers used to retain data on your computer across visits to the same website. We use local storage as a temporary holding area for user events that were observed locally but, due to the timing of a page unload, were unable to be transmitted as part of the user session. Return visits to the same website read and transmit events previously stored in local storage to complete previously recorded sessions.

    This information may in the aggregate identify a User, however we will not identify a User as they browse the web if the User turns off cookies, as explained below.

    FullStory does not and will not ever attempt to identify the same person across disparate, unrelated domains. It is a violation of our Acceptable Use Policy for our customers to attempt to build multi-site user profiles for the intent of selling or exchanging lists of users or demographic information.

    Opting Out
    If you wish to prevent all websites using the FullStory Services to be able to record an its activity, you can opt-out of the FullStory Services. Opting out will create a cookie that tells FullStory to turn off recording on any site which uses the FullStory Services. The presence of this cookie is required to continue opting out, so if you clear your browser cookies, you will have to opt-out again. (We regret that there isn't a better way to make your opt-out more permanent, but due to technical reasons, this really is the best we can do at present.)

    One more thing.
    If you are considering opting-out, it's probably a good time to make sure you really understand that the purpose of the FullStory Services is to help well-intentioned companies make their website better for you. It is emphatically not one of those we-track-you-around-the-web kind of deals. We think that's creepy, too.

    Most people who make websites are just like you: nice people who want to do a good job and make something awesome. And you wouldn't believe how much time and energy product teams spend trying to make their websites great for you. Without the FullStory Services, though, they simply do not have enough information to understand when they get it wrong. If they can see how you actually experience their website, like an ongoing usability study, they'll actually know what to improve! They don't need to record anything sensitive in order to do that, and we have a strict Acceptable Use Policy where you can see for yourself the high standards we expect of FullStory customers with respect to your privacy.

    Blocking Cookies
    If you choose, you can set your browser to reject cookies or you can manually delete individual or all of the cookies on your computer by following your browser’s help file directions. Note that turning off cookies may also disable functions of many websites you visit. If your browser is set to reject cookies or you manually delete cookies, FullStory will not be able to coalesce your anonymous user identity automatically into sessions across pages on the same website.

    FullStory could in principle coalesce your user identity across pages of a single website even if you are blocking cookies if (1) you are logged into the website of a FullStory customer and (2) that customer uses the JavaScript API to identify you using an application-unique identifier.

    EU-US Privacy Shield Framework.

    FullStory has further committed to refer unresolved privacy complaints under the Privacy Shield Principles, to the BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://www.bbb.org/EU-privacy-shield/file-a-complaint for more information and to file a complaint.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Users are also entitled to learn about the legal basis for Data transfers abroad including to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.

Details about the right to object to processing

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time, free of charge and without providing any justification. Where the User objects to processing for direct marketing purposes, the Personal Data will no longer be processed for such purposes. To learn whether the Owner is processing Personal Data for direct marketing purposes, Users may refer to the relevant sections of this document.

How to exercise these rights

Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. Such requests are free of charge and will be answered by the Owner as early as possible and always within one month, providing Users with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by the Owner to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort. At the Users’ request, the Owner will inform them about those recipients.

Transfer of Personal Data outside of the European Union

Data transfer abroad based on consent

If this is the legal basis, Personal Data of Users shall be transferred from the EU to third countries only if the User has explicitly consented to such transfer, after having been informed of the possible risks due to the absence of an adequacy decision and appropriate safeguards.
In such cases, the Owner shall inform Users appropriately and collect their explicit consent via this Application.

Other legal basis for Data transfer abroad

If no other legal basis applies, Personal Data shall be transferred from the EU to third countries only if at least one of the following conditions is met:

  • the transfer is necessary for the performance of a contract between the User and the Owner or of pre-contractual measures taken at the User’s request;
  • the transfer is necessary for the conclusion or performance of a contract concluded in the interest of the User between the Owner and another natural or legal person;
  • the transfer is necessary for important reasons of public interest;
  • the transfer is necessary for establishment, exercise or defence of legal claims;
  • the transfer is necessary in order to protect the vital interests of the data subject or of other persons, where the data subject is physically or legally incapable of giving consent. In such cases, the Owner shall inform the User about the legal bases the transfer is based on via this Application.

Data transfer to countries that guarantee European standards

If this is the legal basis, the transfer of Personal Data from the EU to third countries is carried out according to an adequacy decision of the European Commission.
The European Commission adopts adequacy decisions for specific countries whenever it considers that country to possess and provide Personal Data protection standards comparable to those set forth by EU data protection legislation. Users can find an updated list of all adequacy decisions issued on the European Commission's website.

Data transfer abroad based on standard contractual clauses

If this is the legal basis, the transfer of Personal Data from the EU to third countries is carried out by the Owner according to “standard contractual clauses” provided by the European Commission.
This means that Data recipients have committed to process Personal Data in compliance with the data protection standards set forth by EU data protection legislation. For further information, Users are requested to contact the Owner through the contact details provided in the present document.
