Pushwoosh, Inc. and its group of companies (Pushwoosh, “Us”, “Our”, or “We”) are committed to protecting Your privacy. This Services Privacy Policy sets out how We collect and process personal information through Our push notifications delivery platform and related services including the development, transmission, analysis, and management of push notifications and email messages and other digital communications and tools (the “Services”) and generally in the course of doing business – such as when an individual who has registered to use the Services (“Customer”), potential Customer, or other third party engages with Us in relation to the provision of the Services (collectively “You”).
This Services Privacy Policy (this “Policy”) does not cover how Pushwoosh collects and uses personal information collected from individuals who visit Our website (“Visitors”), as described in Our separate Website Privacy Policy.
1. Information Collected Through the Services
Through Our Services, Pushwoosh collects certain personal information, as follows:
a. Information Customers Provide to Us:
You may provide personal information to Us through the Services – for example, when You create a Pushwoosh account, use the Services to send emails or other communications, contact customer support, send Us an email, or communicate with Us in any other way. When setting up a Pushwoosh account, You will be asked to provide certain basic information such as a name, email address, username, password, company name, occupation, location and phone number (e.g. if You are using two-factor authentication). If You purchase one of Our paid plans, You may also need to provide Us with payment and billing information such as the Customer’s credit card details and billing address. As a Customer, Pushwoosh will also maintain a record of Your purchases, transactional information, Services history and usage, and any communications and responses. We may also collect personal information, such as Your contact information, job details and feedback, when You attend Our events, take part in surveys, or through other business or marketing interactions We may have with You.
b. Information We Collect Automatically Through the Services:
When You use the Services, We may collect certain information automatically about Your device and Your use of the Services. This will include IP addresses, browser types, log files, and other information regarding Your system and connection. We collect information about how You access and use the Services, such as what pages are viewed and what portions of the Services are used. We also collection information regarding the performance of the Services, including metrics related to the deliverability of push notifications, emails and other electronic communications You send through the Pushwoosh platform. This information allows Us to improve the content and operation of the Services, and facilitate research and analysis of the Services. Please be aware that We use web beacons in Our emails to recipients delivered using the Pushwoosh platform. These web beacons track certain behavior such as whether the email sent through the Pushwoosh platform was delivered, opened, clicked on, whether it bounced or was treated as spam. This allows Us to measure the performance of Our Customer’s email campaigns, and to provide analytics information and enhance the effectiveness of Our Services. We collect this information automatically through the use of various commonly used information-gathering technologies including cookies and web beacons, to collect information as users and Visitors navigate the Website and use the Services (“Web Site Navigational Information”). We use these technologies to analyze trends, administer Web sites and Services, track users’ and Visitors’ movements around Our Website and Services, serve targeted advertisements and gather demographic information about Our user and Visitor base as a whole. c. Information We Process on Behalf of Our Customers:
Pushwoosh Customers may also input or upload certain personal information to the Pushwoosh platform which We will process as a data processor on Our Customers’ behalf. For example, when Our Customers use Our push notifications or email delivery platform to upload contact information relating to their recipients, push tokens, device identifiers, other personal information about recipients, or upload contents of email communications, or create marketing campaigns, We will act as a data processor and only process such information on Our Customer’s behalf and in accordance with their instructions (as defined in Our Customer agreements). We will use such personal information to: provide and deliver the Services to the Customer, prevent or address any service or technical issues, respond to a Customer’s request, instructions or support request, or for any other purpose provided for in the Customer agreement, or in accordance with or as may be required by law. In such cases, it is the Customer (or, as the case may be, other third parties) who remain responsible for the handling of the personal information and with compliance with any applicable data privacy laws. If You have questions or concerns about how such personal information is handled, You should contact the relevant entity that is using the Services, and refer to their separate privacy policies.
2. Use of Information
We may use the information We collect through the Services for a range of reasons. Aside from where We are processing personal information as a processor (see Section 1(c) above), We use Your personal information for purposes which include:
o To provide, operate, optimize and maintain the Services;
o To deal with Customer enquiries and support requests, and to provide information and access to resources or services that they have requested from Us;
o To manage the Pushwoosh platform, system administration and security;
o To process and complete transactions;
o To compile aggregated statistics about the operation and use of the Services and to better understand the preferences of Our Customers;
o To send Our Customers technical alerts, reports, updates, security notifications and other Service-related communications;
o To carry out research and development to improve Our products and services;
o To send You marketing communications (where this is in accordance with Your communication preferences);
o Investigate and prevent fraud, unauthorized access or use of Services, breaches of terms and policies, and other wrongful behavior;
o To carry out other legitimate business purposes, as well as other lawful purposes about which We will notify You.
3. Information We Share

o Within the Pushwoosh group of companies for the purposes outlined in this Policy.

When You use these types of Services, We will ensure that the identity of those partners or sponsors is clearly visible and that You have an opportunity not to proceed or to opt out. 5. Our Security
We maintain reasonable and appropriate security measures to protect Your personal information from loss, misuse, and unauthorized access, disclosure, alteration and destruction. We will take all reasonable steps to ensure the safety of Your personal information.
6. Sensitive Data
Pushwoosh does not knowingly solicit or collect, and You should not provide, any information regarding individual’s medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs or other Sensitive Data, as such term is defined in the Pushwoosh Terms of Service.
7. Information about International Transfers
Your personal information may be stored and processed by Us in any country where We have facilities or where We engage service providers, and by reading this Policy and using the Services You acknowledge that Your personal information may be transferred to countries outside of Your country of residence, including the United States, which may have different data protection rules to those of Your country. Where We do so, Our collection, storage and use of Your personal information will be in accordance with the purposes set out in this Policy. For personal information We receive from the EEA and Switzerland, Pushwoosh, Inc. participates and complies with the Privacy Shield Framework as set forth by the US Department of Commerce. 8. Your Choices and Opt-Outs
You can opt out of receiving marketing emails from Us at any time, or opt out from having Your contact information shared with third parties for direct marketing purposes. You can opt out of Our marketing emails by clicking the ‘unsubscribe’ link at the bottom of Our marketing messages.
Also, all opt out requests can be made by emailing Us at privacy@pushwoosh.com . Please note that it may take up to 10 days to remove Your contact information from Our marketing communications lists, so You may receive correspondence from Us for a short time after You make a request.
Please note that some communications (such as service messages, account notifications, billing information) are considered transactional and necessary for account management and You cannot opt out of these messages unless You request to deactivate their Pushwoosh account.
9. Other data rights
Pushwoosh takes reasonable steps to ensure that the data We collect is reliable for its intended use, accurate, complete and up to date. You can manage many of Your account and profile settings within the dashboard provided through the Pushwoosh platform. However, if You want to contact Us directly about accessing, changing or deleting Your personal information, or altering Your data or marketing preferences, please email Us at privacy@pushwoosh.com . We will consider Your request in accordance with applicable laws.
10. Your California Privacy Rights
California law provides that California residents have a right to request that businesses tell them how their personally identifiable information has been shared with third parties for those third parties’ direct marketing purposes. Oltre al Titolare, in alcuni casi, potrebbero avere accesso ai Dati altri soggetti coinvolti nell’organizzazione di greenApes (personale amministrativo, commerciale, marketing, legali, amministratori di sistema) ovvero soggetti esterni (come fornitori di servizi tecnici terzi, corrieri postali, hosting provider, società informatiche, agenzie di comunicazione) nominati anche, se necessario, Responsabili del Trattamento da parte del Titolare. L’elenco aggiornato dei Responsabili potrà sempre essere richiesto al Titolare del Trattamento.
Il Titolare tratta Dati Personali relativi all’Utente in caso sussista una delle seguenti condizioni:
È comunque sempre possibile richiedere al Titolare di chiarire la concreta base giuridica di ciascun trattamento ed in particolare di specificare se il trattamento sia basato sulla legge, previsto da un contratto o necessario per concludere un contratto.

I Dati Personali dell’Utente potrebbero essere trasferiti in un paese diverso da quello in cui l’Utente si trova. Per ottenere ulteriori informazioni sul luogo del trattamento l’Utente può fare riferimento alla sezione relativa ai dettagli sul trattamento dei Dati Personali.
L’Utente ha diritto a ottenere informazioni in merito alla base giuridica del trasferimento di Dati al di fuori dell’Unione Europea o ad un’organizzazione internazionale di diritto internazionale pubblico o costituita da due o più paesi, come ad esempio l’ONU, nonché in merito alle misure di sicurezza adottate dal Titolare per proteggere i Dati.
L’Utente può verificare se abbia luogo uno dei trasferimenti appena descritti esaminando la sezione di questo documento relativa ai dettagli sul trattamento di Dati Personali o chiedere informazioni al Titolare contattandolo agli estremi riportati in apertura.
I Dati sono trattati e conservati per il tempo richiesto dalle finalità per le quali sono stati raccolti.
Pertanto:
Quando il trattamento è basato sul consenso dell’Utente, il Titolare può conservare i Dati Personali più a lungo sino a quando detto consenso non venga revocato. Inoltre, il Titolare potrebbe essere obbligato a conservare i Dati Personali per un periodo più lungo in ottemperanza ad un obbligo di legge o per ordine di un’autorità.
Al termine del periodo di conservazione i Dati Personali saranno cancellati. Pertanto, allo spirare di tale termine il diritto di accesso, cancellazione, rettificazione ed il diritto alla portabilità dei Dati non potranno più essere esercitati.
I Dati dell’Utente sono raccolti per consentire al Titolare di fornire il Servizio, adempiere agli obblighi di legge, rispondere a richieste o azioni esecutive, tutelare i propri diritti ed interessi (o quelli di Utenti o di terze parti), individuare eventuali attività dolose o fraudolente, nonché per le seguenti finalità: Monitoraggio dell'infrastruttura, Statistica, Gestione contatti e invio di messaggi, Registrazione ed autenticazione, Remarketing e behavioral targeting, Accesso agli account su servizi terzi, Visualizzazione di contenuti da piattaforme esterne, Gestione dei dati di attività, Hosting ed infrastruttura backend e Gestione della raccolta dati e dei sondaggi online.

GreenApes può richiedere alcuni permessi Facebook che le consentono di eseguire azioni con l’account Facebook dell’Utente e di raccogliere informazioni, inclusi Dati Personali, da esso. Questo servizio permette a greenApes di connettersi con l'account dell'Utente sul social network Facebook, fornito da Facebook Inc.

Oltre a qualsiasi funzione di opt-out fornita da uno qualsiasi dei servizi elencati in questo documento, gli Utenti possono avvalersi delle informazioni presenti su

The Network Advertising Initiative (USA) e Digital Advertising Alliance (USA), DAAC (Canada), DDAI (Giappone)
o altri servizi analoghi. Con questi servizi è possibile gestire le preferenze di tracciamento della maggior parte degli strumenti pubblicitari. Il Titolare, pertanto, consiglia agli Utenti di utilizzare tali risorse in aggiunta alle informazioni fornite nel presente documento.
Gli Utenti possono inoltre disattivare alcune funzioni pubblicitarie attraverso le rispettive impostazioni del dispositivo, come le impostazioni pubblicitarie del dispositivo per i telefoni cellulari o le impostazioni degli annunci in generale.
Gli Utenti possono esercitare determinati diritti con riferimento ai Dati trattati dal Titolare.

Su richiesta dell’Utente, in aggiunta alle informazioni contenute in questa privacy policy, greenApes potrebbe fornire all'Utente delle informative aggiuntive e contestuali riguardanti Servizi specifici, o la raccolta ed il trattamento di Dati Personali.
Per necessità legate al funzionamento ed alla manutenzione, greenApes e gli eventuali servizi terzi da essa utilizzati potrebbero raccogliere log di sistema, ossia file che registrano le interazioni e che possono contenere anche Dati Personali, quali l’indirizzo IP Utente.
Ulteriori informazioni in relazione al trattamento dei Dati Personali potranno essere richieste in qualsiasi momento al Titolare del Trattamento utilizzando gli estremi di contatto.
GreenApes non supporta le richieste “Do Not Track”.
Per scoprire se gli eventuali servizi di terze parti utilizzati le supportino, l'Utente è invitato a consultare le rispettive privacy policy.
Il Titolare del Trattamento si riserva il diritto di apportare modifiche alla presente privacy policy in qualunque momento notificandolo agli Utenti su questa pagina e, se possibile, su greenApes nonché, qualora tecnicamente e legalmente fattibile, inviando una notifica agli Utenti attraverso uno degli estremi di contatto di cui è in possesso. Si prega dunque di consultare con frequenza questa pagina, facendo riferimento alla data di ultima modifica indicata in fondo.
Qualora le modifiche interessino trattamenti la cui base giuridica è il consenso, il Titolare provvederà a raccogliere nuovamente il consenso dell’Utente, se necessario.
