Types of Data collected

Among the types of Personal Data that nearit collects, by itself or through third parties, there are: Cookies, Usage Data, email address and geographic position.

Complete details on each type of Personal Data collected are provided in the dedicated sections of this privacy policy or by specific explanation texts displayed prior to the Data collection.
The Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using nearit.
All Data requested by nearit is mandatory and failure to provide this Data may make it impossible for nearit to provide its services. In cases where nearit specifically states that some Data is not mandatory, Users are free not to communicate this Data without any consequences on the availability or the functioning of the service.
Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.
Any use of Cookies — or of other tracking tools — by nearit or by the owners of third-party services used by nearit serves the purpose of providing the service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available.

Users are responsible for any third-party Personal Data obtained, published or shared through nearit.

Mode and place of processing the Data

Methods of processing

The Data Controller processes the Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Data Controller at any time.

Retention time

The Data is kept for the time necessary to provide the service requested by the User, or stated by the purposes outlined in this document, and the User can always request that the Data Controller suspend or remove the data.

The Data concerning the User is collected to allow the Owner to provide its Service, comply with its legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as the following: Handling payments, Analytics, Heat mapping and session recording, User database management, Contacting the User, Managing contacts and sending messages, Remarketing and behavioral targeting, Advertising, Location-based interactions and Hosting and backend infrastructure.

Personal Data is collected for the following purposes and using the following services:

  • Advertising

    This type of service allows User Data to be utilized for advertising communication purposes. These communications are displayed in the form of banners and other advertisements on nearit, possibly based on User interests.
    This does not mean that all Personal Data are used for this purpose. Information and conditions of use are shown below.
    Some of the services listed below may use Trackers for identifying Users, behavioral retargeting i.e. displaying ads tailored to the User’s interests and behavior, or to measure ads performance. For more information, please check the privacy policies of the relevant services.
    Services of this kind usually offer the possibility to opt out of such tracking.     Google Ads conversion tracking (Google Inc.)

    Google Ads conversion tracking is an analytics service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing, that connects data from the Google Ads advertising network with actions performed on nearit.

    Meta ads conversion tracking (Meta pixel) (Facebook, Inc.)

    Meta ads conversion tracking (Meta pixel) is an analytics service provided by Meta Platforms, Inc. or by Meta Platforms Ireland Limited, depending on how the Owner manages the Data processing, that connects data from the Meta Audience Network with actions performed on nearit. The Meta pixel tracks conversions that can be attributed to ads on Facebook, Instagram and Meta Audience Network.

    Microsoft Advertising (Microsoft Corporation)

    Microsoft Advertising is an advertising service provided by Microsoft Corporation.

    Yahoo Advertising conversion tracking (Yahoo! Inc.)

    Yahoo Advertising conversion tracking is an analytics service provided by Yahoo! Inc. that connects data from the Yahoo advertising network with actions performed on nearit.

  • Analytics

    The services contained in this section enable the Owner to monitor and analyze web traffic and can be used to keep track of User behavior.

    Google Analytics (Universal Analytics) with anonymized IP (Google Inc.)

    Google Analytics (Universal Analytics) is a web analysis service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing, (“Google”). Google utilizes the Data collected to track and examine the use of nearit, to prepare reports on its activities and share them with other Google services.
    Google may use the Data collected to contextualize and personalize the ads of its own advertising network.
    This integration of Google Analytics anonymizes your IP address. It works by shortening Users' IP addresses within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the complete IP address be sent to a Google server and shortened within the US.

  • Contacting the User

    Mailing List or Newsletter (Nearit)

    By registering on the mailing list or for the newsletter, the User’s email address will be added to the contact list of those who may receive email messages containing information of commercial or promotional nature concerning nearit. Your email address might also be added to this list as a result of signing up to nearit or after making a purchase.

  • Handling payments

    Payment processing services enable nearit to process payments by credit card, bank transfer or other means. To ensure greater security, nearit shares only the information necessary to execute the transaction with the financial intermediaries handling the transaction.
    Some of these services may also enable the sending of timed messages to the User, such as emails containing invoices or notifications concerning the payment.

    Stripe (Stripe Inc)

    Stripe is a payment service provided by Stripe Inc.

  • Heat mapping and session recording

    Heat Mapping services are used to display the areas of a page where Users most frequently move the mouse or click. This shows where the points of interest are. These services make it possible to monitor and analyze web traffic and keep track of User behavior.
    Some of these services may record sessions and make them available for later visual playback.

    Inspectlet (Inspectlet Inc.)

    Inspectlet is a session recording and heat mapping service provided by Inspectlet Inc.

  • Hosting and backend infrastructure

    This type of services has the purpose of hosting data and files that enable nearit to run and be distributed as well as to provide a ready-made infrastructure to run specific features or parts of nearit. Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored.

    Amazon Web Services (AWS) (Amazon)

    Amazon Web Services (AWS) is a hosting and backend service provided by Amazon Web Services, Inc.

  • Location-based interactions

    Geolocation (Nearit)

    Nearit may collect, use, and share User location Data in order to provide location-based services.
    Most browsers and devices provide tools to opt out from this feature by default. If explicit authorization has been provided, the User’s location data may be tracked by nearit.

  • Managing contacts and sending messages

    This type of services makes it possible to manage a database of email contacts, phone contacts or any other contact information to communicate with the User.
    These services may also collect data concerning the date and time when the message was viewed by the User, as well as when the User interacted with it, such as by clicking on links included in the message.

    Mailchimp (The Rocket Science Group, LLC.)

    Mailchimp is an email address management and message sending service provided by Intuit Inc.

  • Remarketing and behavioral targeting

    This type of service allows nearit and its partners to inform, optimize and serve advertising based on past use of nearit by the User.
    This activity is facilitated by tracking Usage Data and by using Trackers to collect information which is then transferred to the partners that manage the remarketing and behavioral targeting activity.
    Some services offer a remarketing option based on email address lists.
    In addition to any opt-out feature provided by any of the services below, Users may opt out by visiting the Network Advertising Initiative opt-out page.

    Users may also opt-out of certain advertising features through applicable device settings, such as the device advertising settings for mobile phones or ads settings in general.

    Google Ads Remarketing (Google Inc.)

    Google Ads Remarketing is a remarketing and behavioral targeting service provided by Google LLC or by Google Ireland Limited, depending on how the Owner manages the Data processing, that connects the activity of nearit with the Google Ads advertising network and the DoubleClick Cookie.

    Users can opt out of Google's use of cookies for ads personalization by visiting Google's Ads Settings.

  • User database management

    This type of services allows the Owner to build user profiles by starting from an email address, a personal name, or other information that the User provides to nearit, as well as to track User activities through analytics features. This Personal Data may also be matched with publicly available information about the User (such as social networks' profiles) and used to build private profiles that the Owner can display and use for improving nearit.
    Some of these services may also enable the sending of timed messages to the User, such as emails based on specific actions performed on nearit.

    Intercom (Intercom Inc.)

    Intercom is a User database management service provided by Intercom Inc. Intercom can also be used as a medium for communications, either through email, or through messages within our product(s).

    Personal Data processed: email address and various types of Data as specified in the privacy policy of the service.

  • Direct registration

    The User registers by filling out the registration form and providing the Personal Data directly to this Application.

    Personal Data collected: Name, Surname, Email, Telephone number, Skype ID, Password, Type of user (Company, Developer, Student, Other).

  • User Profiling

    If the User gives its consent to such treatment, the Owner may save and use the acquired Personal Data according to the present document to create Users related profiles, in order to send marketing and/or promotional messages in line with the preferences provided by the latter, even during their browsing activity on nearit.
    The User will always have the possibility to withdraw its consent to the profiling activity simply by sending an email to the contact information provided in this Agreement.

  • Communication of end-Customers' Personal Data

    In order to provide the Service that is contractually due, the Owner has to acquire the Customers' Personal Data to whom the Users intend to send custom promotional messages. These Data must be communicated to the User. It is up to the User to acquire such Data from the end-Customers in accordance with the applicable regulation, in particular obtaining the necessary consent by the same Users.
    The Personal Data which are communicated will never be different from those that the end Customers gave consent to for the communication of Data to third parties. Such Personal Data will be used, other than to provide the Service, to carry out statistical surveys and analysis at an aggregated level.
    Towards the end-Customers, the User, being it a Marketer or a Developer, declares to be aware of gaining the status of data processor (nominated by the Owner for that purpose) or of data controller in accordance with the D.Lgs. 196/2003 (“Privacy Code”) and commits itself, within the limits of its competence, to process Personal Data in compliance with the applicable law with regards to the protection, the processing and the security of Personal Data, as well as, where appropriate, in compliance with the instructions given by the data controller.
    In any case, the subject who acquires the qualification of data controller towards the end-Customer (i.e the Developer and/or Marketer) has the duty to provide the application with the information pursuant to art. 13 of the Privacy Code and, furthermore, has the duty to inform about the Data processing carried out through nearit in the privacy policy.
    Moreover, such data controller will have to gather every Clients' consent regarding, as a non exhaustive example, the communication to third parties, the User's geolocation, the marketing activity, the newsletter subscription etc.
    In any case, the responsibility for the proper gathering of the consent by the end Users for the processing and the communication to third parties of the Personal Data, the possibility for the Clients to access such data or to put an end on the processing as well as the responsibility for the fulfillment of obligations towards the Data Protection Authority, lies entirely on the User.

  • Push notifications

    Nearit may send push notifications to the User.

Legal action

The User's Personal Data may be used for legal purposes by the Data Controller, in Court or in the stages leading to possible legal action arising from improper use of nearit or the related services.
The User declares to be aware that the Data Controller may be required to reveal personal data upon request of public authorities.

In addition to the information contained in this privacy policy, nearit may provide the User with additional and contextual information concerning particular services or the collection and processing of Personal Data upon request.

System logs and maintenance

For operation and maintenance purposes, nearit and any third-party services may collect files that record interaction with nearit (System logs) or use other Personal Data (such as the IP Address) for this purpose.

The rights of Users based on the General Data Protection Regulation (GDPR)

Users have the right, at any time, to know whether their Personal Data has been stored and can consult the Data Controller to learn about their contents and origin, to verify their accuracy or to ask for them to be supplemented, cancelled, updated or corrected, or for their transformation into anonymous format or to block any data held in violation of the law, as well as to oppose their treatment for any and all legitimate reasons. Nearit does not support “Do Not Track” requests.

Changes to this privacy policy

The Data Controller reserves the right to make changes to this privacy policy at any time by giving notice to its Users on this page. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom. If a User objects to any of the changes to the Policy, the User must cease using nearit and can request that the Data Controller remove the Personal Data. Unless stated otherwise, the then-current privacy policy applies to all Personal Data the Data Controller has about Users.

User

The individual using nearit, which must coincide with or be authorized by the Data Subject, to whom the Personal Data refers.

Data Subject

The legal or natural person to whom the Personal Data refers.

Data Processor (or Processor)

The natural person, legal person, public administration or any other body, association or organization authorized by the Data Controller to process the Personal Data in compliance with this privacy policy.

Data Controller (or Owner)

Client

Natural or legal person who uses an application within which the Service provided by nearit is incorporated.
