This Application provides automated transcription services that uses third party speech recognition technologies to transcribe audio and video files uploaded by the User. Any such audio or video files uploaded by the User for the purpose of using this Application’s transcription services may contain Personal Data about the User or another Data Subject. The User, and not the Application, is responsible for any such Personal Data contained in any submitted files, whether about the User or about another Data Subject.
This Application collects, stores and transmits such Data as part of the automated transcription services offered. When the User purchases transcription services, this Application retains copies of such information for a certain amount of time unless deleted by the User (as provided in more detail below), which may contain Personal Data, and which is linked with the User’s account information on the servers of this Application. To process automated transcriptions of an audio or video file submitted by the User, this Application transmits audio content from such file to third party speech recognition platforms or APIs.
When this Application transmits such audio content to third party speech recognition platforms or APIs, Personal Data and other Data may be contained in such audio content. To the extent any such Data is transmitted to third party speech recognition platforms, such Data is out of the control of this Application and may be subject to the policies of, and the potential use, retention and storage by, such third party providers. The Application has no control over whether any such third party APIs retain, store, transmit or use any such Personal Data or other Data in any content or files transmitted for transcription.
Audio and video files submitted by the User to the Application, including content from such files necessary to provide automated transcription services, and any other Data and content provided by or on behalf of the User related thereto (including any transcripts, any annotations of transcripts, bookmarks, timestamps, labels or other edits to any transcript) and any information derivative therefrom (collectively, “User Content”), is stored and retained on the servers of this Application and indexed to such User’s ID for a certain period of time depending on the User’s account, unless deleted and removed by the User prior to the normal retention date for such User Content.
User Content is retained by this Application only for convenience to the User so that the User may retrieve such User Content from the Application when desirable after the processing of any transcriptions. However, User Content is the property of the User and the User may delete and remove any and all User Content from the Application in its entirety at any time, at the User’s sole discretion, using functionality available on the Application. Deletion and removal by a User of its User Content from the Application is final and such User Content cannot be retrieved, and no copy is retained by or on the Application, after such deletion and removal therefrom. Deletion and removal of any User Content related to a transcription will cause and entail deletion and removal from the Application of all User Content applicable to such transcription, including all audio and video files in respect of such transcription, any transcripts from such transcription, and any User annotations, edits, labels or other Data and content related to such transcript and transcription.
User Content that is not deleted and removed by a User will be retained by the Application for the following time periods, solely for the convenience of the User, after which such User Content will be deleted and removed in its entirety by the Application. For Users that are subscribers to the transcription services, User Content will be retained and stored on the Application for the duration of the User’s subscription and for six months following the termination of the User’s subscription (unless earlier deleted and removed by the User as provided above). If the User is not a subscriber, User Content will be stored for six months from the last date on which the User purchased any automated transcription services on the Application (unless earlier deleted and removed by the User as provided above).
The deletion and removal of any User Content from the Application by the User or by the Application will not affect whether any Data is retained by any third party speech recognition platforms to which such Data has been transmitted as part of the automated transcription services. Any Data transmitted to third party speech recognition platforms as part of the automated transcription services is out of the control of this Application and may be subject to the policies of, and the potential use, retention and storage by, such third party providers.
The Personal Data collected are used to provide the User with services or to sell goods, including payment and possible delivery.
The Personal Data collected to complete the payment may include the credit card, the bank account used for the transfer, or any other means of payment envisaged. The kind of Data collected by this Application depends on the payment system used.
