    • Buddy Press

      Website Visitors

      Like most website operators, BuddyPress.org collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. BuddyPress.org’s purpose in collecting non-personally identifying information is to better understand how BuddyPress.org’s visitors use its website. From time to time, BuddyPress.org may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

      BuddyPress.org also collects potentially personally-identifying information like Internet Protocol (IP) addresses. BuddyPress.org does not use such information to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

      Gathering of Personally-Identifying Information

      Certain visitors to BuddyPress.org’s websites choose to interact with BuddyPress.org in ways that require BuddyPress.org to gather personally-identifying information. The amount and type of information that BuddyPress.org gathers depends on the nature of the interaction. For example, we ask visitors who use our forums to provide a username and email address. In each case, BuddyPress.org collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with BuddyPress.org. BuddyPress.org does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

      Protection of Certain Personally-Identifying Information

      BuddyPress.org discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on BuddyPress.org’s behalf or to provide services available at BuddyPress.org’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using BuddyPress.org’s websites, you consent to the transfer of such information to them. BuddyPress.org will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors, and affiliated organizations, as described above, BuddyPress.org discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when BuddyPress.org believes in good faith that disclosure is reasonably necessary to protect the property or rights of BuddyPress.org, third parties, or the public at large. If you send us a request (for example via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. BuddyPress.org takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally-identifying information.

      Cookies

      A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. BuddyPress.org uses cookies to help BuddyPress.org identify and track visitors, their usage of BuddyPress.org website, and their website access preferences. BuddyPress.org visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using BuddyPress.org’s websites, with the drawback that certain features of BuddyPress.org’s websites may not function properly without the aid of cookies.

      Privacy Policy Changes

      Although most changes are likely to be minor, BuddyPress.org may change its Privacy Policy from time to time, and in BuddyPress.org’s sole discretion. BuddyPress.org encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

      SECTION 11 – PERSONAL INFORMATION (PRIVACY)

      It is FooEvents’s policy to respect your privacy regarding any information that we may collect while operating our websites.

      Website Visitors

      Like most website operators, FooEvents collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. FooEvents’s purpose in collecting non-personally identifying information is to better understand how FooEvents’s visitors use its website. From time to time, FooEvents may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

      Gathering of Personally-Identifying Information

      Certain visitors to FooEvents’s websites choose to interact with FooEvents in ways that require FooEvents to gather personally-identifying information. The amount and type of information that FooEvents gathers depends on the nature of the interaction. For example, we ask customers who purchase a plugin or require support to provide a username and email address. FooEvents collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with FooEvents. FooEvents does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

      Protection of Certain Personally-Identifying Information

      FooEvents discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on FooEvents’s behalf or to provide services available at FooEvents’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using FooEvents’s websites, you consent to the transfer of such information to them. FooEvents will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, FooEvents discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when FooEvents believes in good faith that disclosure is reasonably necessary to protect the property or rights of FooEvents, third parties or the public at large. If you are a FooEvents customer and have opted in to receive news and updates from us, FooEvents may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with FooEvents and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. FooEvents takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

      Cookies

      A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. FooEvents uses cookies to help FooEvents identify and track visitors, their usage of the FooEvents website, and their website access preferences. FooEvents visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using FooEvents’s websites, with the drawback that certain features of FooEvents’s websites may not function properly without the aid of cookies.

      Business Transfers

      If FooEvents, or substantially all of its assets, were acquired, or in the unlikely event that FooEvents goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of FooEvents may continue to use your personal information as set forth in this policy.

      Privacy Policy Changes
      Although most changes are likely to be minor, FooEvents may change its Privacy Policy from time to time, and in FooEvents’s sole discretion. FooEvents encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

      SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

      Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

      We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

      SECTION 13 – PROHIBITED USES

      In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

      SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

      We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

      We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

      You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

      You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

      In no case shall FooEvents, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

      SECTION 15 – INDEMNIFICATION

      You agree to indemnify, defend and hold harmless FooEvents and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

      SECTION 16 – SEVERABILITY

      In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

      SECTION 17 – TERMINATION

      The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

      These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

      If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

      SECTION 18 – ENTIRE AGREEMENT

      The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

      These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

      Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

      SECTION 19 – GOVERNING LAW

      These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of South Africa.

      SECTION 20 – CHANGES TO TERMS OF SERVICE

      You can review the most current version of the Terms of Service at any time at this page.

      We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

      SECTION 21 – REFUND POLICY

      The item is “not as described”

      An item is “not as described” if it is materially different from the item description or preview. If it turns out the item is “not as described” you will be entitled to a full refund.

      The item doesn’t work the way it should or it contains a security vulnerability

      If an item doesn’t work the way it should and can’t easily be fixed, then you are entitled to a full refund of the item. This includes situations where the item has a problem that would have stopped you from buying it if you’d known about the problem in the first place. If the item can be fixed, then we will do our best to promptly provide an updated release otherwise you will be entitled to a full refund.

      Items that have not been downloaded

      If you have not downloaded a purchased item within 3 months from the date of purchase, you may be eligible for a refund provided that you can supply us with proof of purchase. Although we feel that 3 months is a reasonable timeframe, depending on where you are located, you might have a longer period to claim a refund if you have purchased for personal use and haven’t downloaded the item.

      Why a refund may not be given

      If the item is materially similar to the description and preview and works the way it should, there is no obligation to provide a refund in situations such as the following:

      you don’t want it after you’ve downloaded it;
      the item did not meet your expectations;
      you simply change your mind;
      you bought an item by mistake;
      you do not have sufficient expertise to use the item;
      your hosting provider does not meet the technical requirements;
      you ask for goodwill;
      you’ve requested a refund 30 days or longer after date of purchase; or
      you can no longer access the item because it has been removed (we advise you to download items as soon as you have purchased them to avoid this situation)

      SECTION 22 – PIRACY

      We work very hard to ensure that FooEvents is a viable business. Please don’t pirate or download our products from illegitimate sources as it hurts our ability to develop new products and maintain existing ones. Any person that we believe is using a pirated version of our product/s will be refused support and may be reported to local authorities.

      SECTION 23 – SUPPORT

      Our support operating hours are 08:30am – 5:00pm (GMT/UTC+2), Monday to Friday. We strive to respond to queries within 48 hours during week days but occasionally our response times might be longer depending on support volumes. While we try our best to troubleshoot and resolve all support queries in a professional and timely manner, we can only achieve this if we receive accurate information and full cooperation from the requester. Support requests containing rude, threatening, or vulgar language will not be tolerated.
