Limitation of liability

The terms give User specific legal rights, and User may also have other rights which vary from jurisdiction to jurisdiction. Indemnification

The User agrees to defend, indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees harmless from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from

• User’s violation of any third-party rights, including, but not limited to, any right of privacy or intellectual property rights;
• User’s violation of any statutory law, rule, or regulation;
• any content that is submitted from User’s account, including third party access with User’s unique username, password or other security measure, if applicable, including, but not limited to, misleading, false, or inaccurate information;
• User’s willful misconduct; or
• statutory provision by User or its affiliates, officers, directors, agents, co-branders, partners, suppliers and employees to the extent allowed by applicable law.

Common provisions

No Waiver

The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.

Service interruption

To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates or any other changes, informing the Users appropriately.

Within the limits of law, the Owner may also decide to suspend or discontinue the Service altogether. If the Service is discontinued, the Owner will cooperate with Users to enable them to withdraw personal data or information and will respect Users' rights relating to continued product use and/or compensation, as provided for by applicable law.

Assignment of contract

The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User’s legitimate interests into account. Provisions regarding changes of these Terms will apply accordingly.

Users may not assign or transfer their rights or obligations under these Terms in any way, without the written permission of the Owner.

Severability

Prevalence of national law

Venue of jurisdiction

The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based, as displayed in the relevant section of this document.

Exception for Consumers in Europe

The above does not apply to any Users that qualify as European Consumers, nor to Consumers based in the United Kingdom, Switzerland, Norway or Iceland.

Exception for Consumers in Brazil

The above does not apply to Users in Brazil that qualify as Consumers.

US Users

Each party specifically waives any right to trial by jury in any court in connection with any action or litigation.
Any claims under these terms shall proceed individually and no party shall join in a class action or other proceeding with or on behalf of others.

UK Consumers

Consumers based in England and Wales may bring legal proceedings in connection with these Terms in the English and Welsh courts. Consumers based in Scotland may bring legal proceedings in connection with these Terms in either the Scottish or the English courts. Consumers based in Northern Ireland may bring legal proceedings in connection with these Terms in either the Northern Irish or the English courts.

US Users

Surviving provisions

This Agreement shall continue in effect until it is terminated by either thecookinghacks.com or the User. Upon termination, the provisions contained in these Terms that by their context are intended to survive termination or expiration will survive, including but not limited to the following:

• the User’s grant of licences under these Terms shall survive indefinitely;
• the User’s indemnification obligations shall survive for a period of five years from the date of termination;

• TCH si riserva il diritto di verificare, in ogni momento e senza preavviso, a sua discrezione, il rispetto delle Condizioni Generali nell’utilizzo dei Servizi da parte dell’Utente, riservandosi il diritto di interrompere in via definitiva e senza preavviso l'erogazione dei Servizi al singolo Utente nel caso in cui questi:    non abbia fornito dati personali aggiornati, completi, veritieri e corretti;    abbia ceduto i dati di accesso a terzi;    utilizzi o abbia utilizzato i Servizi per fini o con modalità illegali o che comunque siano incompatibili con la natura dei Servizi forniti (quali, a mero titolo esemplificativo, trasmissione e/o scambio di virus; invio o divulgazione di pubblicità personale; mail “a catena” o per schemi piramidali; pratiche di spamming o junk mailing; trasmissione e/o scambio e/o divulgazione di materiale illecito o comunque di contenuto razzista, calunnioso o diffamatorio, minaccioso, volgare, osceno);    violi o abbia violato le Condizioni Generali o i termini e le condizioni particolari applicabili ad un Servizio.
• In considerazione del fatto che TCH non è in grado di verificare che le informazioni immesse dall’Utente siano veritiere e quindi nemmeno la maggiore o minore età dell’Utente che intenda registrarsi, si comunica che, mentre l’accesso e la navigazione sui Siti è permessa a prescindere dall’età dell’Utente, l’utilizzo dei Servizi è riservato ai maggiorenni.

Sospensione dei Servizi

• TCH si riserva il diritto di sospendere temporaneamente o interrompere, anche definitivamente, in ogni momento e senza preavviso, l'erogazione dei Servizi e anche di un singolo Servizio, così come il diritto di rimuovere anche definitivamente o modificare in qualsiasi momento qualsiasi contenuto o informazione presente nel Sito.
• TCH declina ogni responsabilità in relazione ai potenziali danni causati dall'interruzione dei Servizi ricollegabili ad eventi di forza maggiore imprevedibili ed incontrollabili derivanti a titolo esemplificativo da black-out o da guasti dei server dei Siti o di terze parti fornitori di TCH.
• TCH si riserva il diritto di sospendere e/o interrompere i Servizi a causa di manutenzione o aggiornamento dei sistemi informatici propri o di terze parti fornitrici, mantenendo informati gli Utenti attraverso comunicazioni via e-mail, notizie sui Siti, messaggi nei Servizi.
• TCH declina ogni responsabilità per danni, pretese o perdite, dirette o indirette, derivanti all'Utente per il mancato e/o difettoso funzionamento delle apparecchiature elettroniche dell'Utente stesso o di terzi, di collegamenti telefonici e/o telematici non gestiti direttamente dallo stesso o dai suoi fornitori.

Servizi

• TCH dispone che l'utente potrà sottoscrivere un account gratuito per accedere ai servizi dell'area privata indicati nella pagina Funzioni per gli utenti registrati.
• TCH può aggiungere altri Prodotti e Servizi in ogni momento e secondo la propria convenienza, le cui condizioni verranno dettagliate quando verranno resi disponibili. Naturalmente l’Utente è libero di sottoscrivere (o non sottoscrivere) questi nuovi Prodotti e Servizi.
• TCH si riserva il diritto di fornire Servizi aggiuntivi riscattabili attraverso lo svolgimento di attività che verranno comunicate volta per volta da TCH attraverso apposite comunicazioni. In ogni comunicazione verranno dettagliate le attività da svolgere e le tempistiche al fine di riscattare il Servizio aggiuntivo indicato. Per considerare una attività come compiuta è necessario che l’attività concluda il proprio iter con l’approvazione finale della redazione, che avverrà secondo le tempistiche indicate nell'appposita comunicazione.

Contributi degli Utenti

• L’Utente garantisce che qualsiasi informazione, commento, messaggio, testo, software, dato, suono, musica, fotografia, grafica, video e altro materiale dallo stesso trasmesso, divulgato, scambiato o reso disponibile in qualunque forma tramite i Servizi forniti da TCH tramite i Siti (di seguito, singolarmente “Contributo” e collettivamente i “Contributi”) non viola il diritto d’autore o altri diritti di proprietà intellettuale di terze parti.
• Eventuale materiale protetto da diritto d’autore di terze parti può essere utilizzato solo qualora l'Utente abbia preventivamente acquisito dal titolare del diritto d'autore, i connessi diritti di utilizzazione, quindi solo con il permesso scritto del titolare del diritto e con l'obbligo di citare la fonte e l'esistenza del permesso. Il materiale fotografico, audio e/o video di terzi o riproducente il ritratto di terzi può essere utilizzato solo qualora l'Utente abbia acquisito il consenso dell'autore e del soggetto ritratto. In relazione alla disponibilità di tali diritti e consensi l'Utente si assume ogni responsabilità esonerando completamente TCH da ogni responsabilità.
• TCH declina ogni responsabilità per danni, pretese o perdite, dirette o indirette, derivanti all'Utente o a terzi dalla trasmissione, divulgazione, scambio o messa a disposizione di Contributi forniti dagli Utenti tramite i Servizi. L'Utente pertanto si impegna a manlevare e tenere indenne TCH da qualsiasi rivendicazione e/o pretesa di terzi relativa o comunque connessa ai propri Contributi.
• L’Utente si impegna a non pubblicare, divulgare, “postare”, Contributi contenenti dati sensibili di terzi senza il loro consenso, nonché immettere/pubblicare foto/immagini di minori, forme e/o contenuti a carattere pedo-pornografico, pornografico, osceno, blasfemo, diffamatorio, ingiurioso, molesto, offensivo, contrario all'ordine pubblico o al buon costume, che promuovano o inducano ad attività illegali o che contengano virus o altri programmi danneggianti la funzionalità di sistemi informatici altrui. L’Utente si impegna dunque a utilizzare i Servizi esclusivamente per scopi leciti, essendo a conoscenza che il mancato adempimento a detto impegno potrà renderlo soggetto a responsabilità civile e/o penale.
• TCH dichiara di non svolgere un controllo preventivo sui Contributi.
• TCH, su segnalazione degli Utenti all’indirizzo info@thecookinghacks.com, si impegna tuttavia a valutare la rispondenza dei Contributi a criteri di liceità, veridicità, fondatezza, accuratezza, non ingannevolezza e non offensività, e ad eliminare quei Contributi che non vi rispondano. In ogni caso, TCH si riserva di eliminare a sua discrezione i Contributi non ritenuti idonei alla pubblicazione, trasmissione, divulgazione o messa a disposizione tramite i Servizi. L'Utente che acceda ai Servizi di comunicazione messi a disposizione degli Utenti da TCH, quali a mero titolo esemplificativo, ma non esaustivo, video messaggi, immagini, pareri di esperti, commenti e simili, che possono contenere anche Contributi di altri Utenti, dichiara di essere consapevole della possibilità che tali materiali, nei loro contenuti, risultino offensivi ovvero offendano la sensibilità di determinate persone, e in ogni caso riconosce che la responsabilità per tali materiali o Contributi non può essere attribuita a TCH, ma ai rispettivi Utenti che ne siano autori e/o abbiano reso disponibili tali Contributi.
• TCH non avalla, non sostiene, non sanziona, non incoraggia, non verifica, né concorda con le opinioni, le affermazioni o i commenti espressi nelle aree comuni dei Siti. Resta pertanto inteso che tali opinioni, affermazioni o commenti saranno esclusivamente riferibili agli Utenti che li avranno espressi. Ogni informazione o materiale pubblicato sui Siti da soggetti terzi, consigli e opinioni, inclusi eventuali messaggi rappresentano il punto di vista di coloro che hanno materialmente immesso sui Siti le proprie considerazioni. Tali soggetti terzi saranno direttamente responsabili di tali contenuti. L'Utente accetta pertanto di assumersi ogni rischio inerente all’uso di qualsiasi tipo di Contributo.
• L'Utente rinuncia al diritto esclusivo di riscuotere compensi, personalmente o per il tramite di un ente di gestione collettiva (es. SIAE), per la comunicazione al pubblico o la rappresentazione o esecuzione, anche in forma digitale, dei propri Contributi. Si precisa che la pubblicazione dei Contributi oltre a non comportare alcun compenso per l’Utente, non può essere intesa come esercizio della professione giornalistica o di richiesta per l’ammissione all’iscrizione nel registro dei praticanti giornalisti di cui agli articoli 26 e 33 della L. 69/1963.
• TCH si riserva, a propria esclusiva discrezione, ogni diritto in merito alla pubblicazione, rimozione dal Sito, in maniera temporanea o permanente, di qualsiasi Contributo.

Contenuti degli Utenti trasferiti a terzi

• L’Utente ha la facoltà di trasferire il contenuto dell’area privata a terzi soggetti tramite i Servizi forniti da TCH tramite i Siti.
• Nel caso di trasferimento del contenuto a terzi, l’Utente si assume ogni responsabilità, diritto e/o obbligo, pertanto avrà cura di comunicare al terzo soggetto di essere l’unico responsabile del contenuto trasmesso, manlevando TCH da ogni pretesa e richiesta del terzo. Per quanto compatibili si richiamano e si applicano le condizioni di cui al capitolo 4.

Contenuti degli Utenti trasferiti a TCH

• Nel caso in cui l’Utente intenda partecipare alle attività di TCH per il fine, a titolo esemplificativo, di riscattare Servizi aggiuntivi, e trasferisca il proprio contenuto a TCH garantisce che qualsiasi informazione, commento, messaggio, testo, software, dato, suono, musica, fotografia, grafica, video e altro materiale dallo stesso trasmesso, divulgato, scambiato o reso disponibile a TCH in qualunque forma non viola il diritto d’autore o altri diritti di proprietà intellettuale di terze parti. Eventuale materiale protetto da diritto d’autore di terze parti può essere utilizzato solo qualora l'Utente abbia preventivamente acquisito dal titolare del diritto d'autore, i connessi diritti di utilizzazione, quindi solo con il permesso scritto del titolare del diritto e con l'obbligo di citare la fonte e l'esistenza del permesso. Il materiale fotografico, audio e/o video di terzi o riproducente il ritratto di terzi può essere utilizzato solo qualora l'Utente abbia acquisito il consenso dell'autore e del soggetto ritratto. In relazione alla disponibilità di tali diritti e consensi l'Utente si assume ogni responsabilità esonerando completamente TCH da ogni responsabilità.
• TCH declina ogni responsabilità per danni, pretese o perdite, dirette o indirette, derivanti all'Utente o a terzi dalla trasmissione, divulgazione, scambio o messa a disposizione di Contributi forniti dagli Utenti tramite i Servizi. L'Utente pertanto si impegna a manlevare e tenere indenne TCH da qualsiasi rivendicazione e/o pretesa di terzi relativa o comunque connessa ai propri contenuti inviati sia a terzi sia a TCH.
• L’Utente si impegna a non pubblicare, divulgare, “postare”, contenuti contenenti dati sensibili di terzi senza il loro consenso, nonché immettere/pubblicare foto/immagini di minori, forme e/o contenuti a carattere pedo-pornografico, pornografico, osceno, blasfemo, diffamatorio, ingiurioso, molesto, offensivo, contrario all'ordine pubblico o al buon costume, che promuovano o inducano ad attività illegali o che contengano virus o altri programmi danneggianti la funzionalità di sistemi informatici altrui. L’Utente si impegna dunque a utilizzare i Servizi esclusivamente per scopi leciti, essendo a conoscenza che il mancato adempimento a detto impegno potrà renderlo soggetto a responsabilità civile e/o penale.
• L’Utente che intenda partecipare alle attività di TCH si impegna a rispettare i termini e le condizioni che TCH comunicherà di volta in volta. TCH si riserva, e l’Utente lo concede, il diritto di accettare/modificare/tradurre il contenuto, oppure di respingerlo ovvero richiederne una o più modifiche all’Utente, fino ad approvazione finale della redazione di TCH.
• Il contenuto trasferito dall’Utente, accettato e modificato da TCH, rimane di esclusiva proprietà di TCH; per il contenuto trasferito dall’Utente, accettato e non modificato in alcuna parte di TCH, l'Utente conferisce a TCH, per tutto il mondo, gratuito e perpetuo, il diritto di pubblicare i contenuti sui Siti coerentemente con le finalità dei Servizi, compreso il diritto di concederli in sub-licenza e cederli a terzi, e il diritto di copiare, riprodurre, correggere, adattare, modificare, migliorare, tradurre, riformattare, creare lavori derivati, fabbricare, commercializzare, pubblicare, distribuire, vendere, concedere in licenza, trasferire, noleggiare, trasmettere, eseguire pubblicamente, comunicare al pubblico per via telematica, in qualsiasi modo ora conosciuto o in futuro scoperto, qualsiasi contenuto generato dall'Utente. In caso di richiesta di cancellazione dell’Utenza dai Servizi, i contenuti generati dall’Utente e inviati a TCH non verranno automaticamente rimossi, ma resteranno on-line senza la relativa attribuzione al profilo Utente. TCH rimane a disposizione per valutare le specifiche richieste ricevute attraverso info@thecookinghacks.com
• L'Utente rinuncia al diritto esclusivo di riscuotere compensi, personalmente o per il tramite di un ente di gestione collettiva (es. Manleva

• All’atto della registrazione, l’Utente riconosce la propria esclusiva responsabilità per i Contributi e per i Contenuti, esonerando, manlevando e mantenendo indenne TCH da ogni responsabilità e da ogni effetto pregiudizievole connesso ad azioni legali da chiunque promosse, a richieste di rimborsi, di risarcimenti, di ogni danno diretto o indiretto subito per effetto dell’invio dei Contributi e dei Contenuti.
• L’Utente dichiara e garantisce di avere acquisito legittimamente i Contributi e i Contenuti, con l’invio, ne autorizza espressamente la pubblicazione e lo sfruttamento dei Contributi e dei Contenuti sui Siti, assumendosi ogni responsabilità in ordine ad essi e manlevando e mantenendo indenne TCH da ogni contestazione che sia sollevata da qualsiasi terzo in ordine ai suddetti Contributi e ai Contenuti. In caso di violazione da parte dell’Utente di uno qualsiasi dei diritti di privativa di TCH o di qualsiasi soggetto terzo, TCH potrà sospendere o interrompere l’accesso degli utenti, degli abbonati, dei soggetti registrati e/o dei titolari di account che violino diritti di privativa altrui ed eventualmente agire in giudizio nei loro confronti.
• Date le caratteristiche intrinseche dei Servizi, a TCH non è possibile sottoporre ad alcun tipo di controllo, precedente o successivo, ogni Contributo e Contenuto immesso on-line sui Siti e/o trasferiti a terzi, ad esclusione dei Contenuti specificatamente inviati volontariamente dall’Utente a TCH, che per la parte testuale rimangono l’unica tipologia di Contenuti dell’Utente sottoposti a controllo.
• TCH tuttavia si riserva la facoltà di effettuare qualsiasi tipo di controllo, anche a campione, e declina qualsiasi responsabilità per i Contenuti e i Contributi immessi sui Siti dai propri Utenti, impegnandosi unicamente a provvedere alla tempestiva rimozione dei Contenuti e Contributi oggetto di contestazione da parte di terzi a fronte di idonea segnalazione da parte dell’interessato e/o dell’autorità competente. Nel caso in cui l’Utente ritenga che il proprio diritto di privativa sia stato violato attraverso il Servizio, si prega di informare tempestivamente scrivendo al seguente indirizzo e-mail: info@thecookinghacks.com
• L’Utente si impegna a tenere indenne TCH, impiegati, agenti, rappresentanti e fornitori di servizi esterni in relazione a qualunque rivendicazione o pretesa da parte di terzi e dalle eventuali relative conseguenze pregiudizievoli (incluso il pagamento delle spese legali) che dovessero derivare dal proprio accesso al Servizio e/o dalla propria utilizzazione dello stesso in modo non conforme al Contratto.

• I Siti possono includere collegamenti ipertestuali ad altri siti web gestiti da terze parti, inclusi inserzioni pubblicitarie e altri fornitori di contenuti. Questi siti possono raccogliere i dati e/o richiedere informazioni personali da parte dell'Utente. TCH non esercita né è tenuto ad esercitare alcuna forma di controllo e declina pertanto ogni responsabilità per danni, pretese o perdite, dirette o indirette, derivanti in qualsiasi forma all'Utente dalla visione, dall'uso e/o dal funzionamento dei siti di terzi o servizi di terzi raggiunti tramite tali link.

Diritti di proprietà intellettuale sui Contenuti

• L'Utente riconosce espressamente che tutti i diritti di proprietà industriale e intellettuale, tutelabili sulla base delle norme relative al diritto d'autore (Titolo IX del libro V del c., artt. 2575-2594 c.c., nonché L. 633/1941, come modificata dal D.lgs. 169/1999) e/o del Codice della proprietà industriale, approvato con D.lgs. 30/2005, o di altre disposizioni, a tutela, a puro titolo esemplificativo e non esaustivo, di know-how, codice sorgente, software, hardware, progetti, applicativi, brevetti, segreti industriali, formule, algoritmi, modelli, banche dati e simili, relativi ai Servizi, ai dati e agli altri materiali provenienti da TCH o da terzi, inclusi gli Utenti, comunque messi a disposizione sui Siti o tramite i Servizi in forza delle Condizioni Generali (ovvero, i “Contenuti”), sono e restano di titolarità esclusiva di TCH, che concede all'Utente licenza personale, non cedibile e non esclusiva per l'utilizzo dei Contenuti e dei Servizi conformemente alle Condizioni Generali, restando in ogni caso inteso che l'Utente non può scaricare, copiare, modificare, vendere, cedere, sub-licenziare, conferire o trasferire a terzi o creare lavori derivati da un qualsiasi diritto di proprietà industriale e intellettuale di TCH, né consentire che terzi lo facciano tramite l'Utente o il suo computer e ogni altro device. Non sono considerati Contenuti i prodotti o servizi pubblicizzati sui Siti, i cui diritti di proprietà industriale e intellettuale appartengono ai rispettivi titolari.
• Il download e l'utilizzo in genere di Contenuti per mezzo dei Servizi è permesso esclusivamente per scopi privati: l'Utente riconosce ed espressamente accetta il divieto di riprodurre, copiare, trasmettere, vendere, pubblicare, o sfruttare commercialmente i Contenuti.

Durata e cancellazione

• I Servizi sono forniti a tempo indeterminato, salvo i casi di interruzione previsti ai sensi delle Condizioni Generali.
• All’Utente è data comunque sempre facoltà di richiedere la cancellazione del proprio account e dei propri dati forniti in sede di registrazione, inviando una mail all’indirizzo privacy@thecookinghacks.com, ai sensi di quanto disposto dal D.lgs. 196/2003 e del Regolamento (UE) 2016/679

Modifiche delle Condizioni Generali

• TCH si riserva il diritto di modificare in ogni tempo le Condizioni Generali nonché i termini e le caratteristiche dei Servizi, tramite avvisi generali agli Utenti pubblicati sui Siti o a mezzo comunicazione e-mail all'Utente con indicazione della data di efficacia delle modifiche stesse, che dovrà essere successiva di almeno 10 giorni rispetto a quella dell’avviso.
• Il continuato utilizzo di anche solo un Servizio da parte dell'Utente decorso il termine di cui al paragrafo 11.1 costituisce manifestazione tacita della volontà di accettare le modifiche delle Condizioni Generali.

Legge applicabile e foro competente

• Le Condizioni Generali sono regolate dalla legge italiana.
• Per qualsiasi controversia inerente alle presenti Condizioni Generali, nel caso in cui l'Utente sia un Consumatore, troverà applicazione quanto disposto dal D.lgs. 206/05 e per l’effetto sarà competente la CCIAA di Milano oppure il Foro di Milano.
• Ad ogni modo, prima di iniziare qualsiasi procedimento arbitrale o giudiziale, TCH da un lato e l’Utente/Utenti dall’altro si impegnano affinché le eventuali controversie derivanti dalle presenti Condizioni Generali vengano risolte autonomamente sul presupposto di un equo contemperamento dei rispettivi interessi.

Avvertenze di rischio per gli Utenti

• TCH non assume responsabilità per eventuali abusi commessi dagli Utenti o di cui questi siano vittima per effetto del comportamento di terzi, posti in essere o meno in violazione delle Condizioni Generali.
• È fatta avvertenza agli Utenti che i dati, propri o di altri, pubblicati sulle sezioni pubbliche dei Siti, come ad esempio non esaustivo i commenti alle pagine, dall’Utente e così resi di pubblico dominio saranno consultabili da chiunque acceda a tali Siti, anche mediante funzionalità di ricerca interne al sito e potranno essere indicizzati nei motori di ricerca e rendersi così disponibili anche a soggetti non registrati sui Siti.
• TCH invita gli Utenti a valutare con la dovuta attenzione l’opportunità o meno di pubblicare: i) dati personali (tra cui anche ad esempio il proprio indirizzo e-mail) che possano rilevarne, anche indirettamente, l’identità; ii) foto e/o video che rendano identificabili altre persone e luoghi; iii) altri dati che possano rilevare, anche indirettamente, l’identità di terzi (quali ad esempio, altre persone accomunate all’Utente da simili esperienze o patologie ovvero sottopostesi a simili trattamenti medici).
• TCH non pubblica automaticamente i dati di contatto degli Utenti (tra cui, ad esempio, l'indirizzo e-mail), comunicati all’atto della registrazione unitamente ai commenti e/o ad altri Contributi.
• Ove previsto dai vari Siti, TCH assicura agli Utenti la possibilità di utilizzare il nickname prescelto e di scegliere con quali persone condividere varie informazioni personali. Ove tale possibilità non sia consentita, si raccomanda l’Utente di valutare l’opportunità di condividere sulla rete Internet informazioni relative alla propria identità nonché di carattere personale che possano diventare accessibili a un pubblico indeterminato di persone.
• L’Utente riconosce che TCH, con i suoi servizi, fornisce strumenti utili per evitare la diffusione di dati personali, anche sensibili.
• I Siti trattano nei propri Contenuti anche tematiche relative alla salute, al benessere, alla nutrizione, alle diete, alle malattie. Tali tematiche possono non essere adatte a tutti; si consiglia pertanto all’Utente di accertarsi che i Contenuti del Sito oggetto di consultazione rispondano alle proprie esigenze e siano adatti alla propria età e/o specifiche condizioni di salute e simili. TCH non risponde dei danni lamentati dagli Utenti per eventuali informazioni e/o Contenuti dei Siti che possano aver urtato e/o offeso la loro sensibilità.
• Le informazioni contenute nei Siti in materia di nutrizione, salute, benessere, diete (o comunque argomenti afferenti a tali ambiti) sono messe a disposizione degli Utenti a scopo puramente divulgativo. Queste informazioni non possono e non intendono in alcun modo sostituire il rapporto con un medico o altro professionista della salute. Pertanto qualora l’Utente ritenga di avere bisogno di una consulenza con riguardo agli argomenti trattati sui Siti si invita di rivolgersi direttamente ad un medico e/o specialista o professionista della salute per l'indicazione di un eventuale corretto programma terapeutico e/o dietetico e/o di allenamento e/o di allattamento e/o di riabilitazione e/o di integrazione alimentare.
• In nessun caso TCH, gli autori degli articoli, né altri soggetti connessi a Siti, potranno essere ritenuti responsabili di qualsiasi eventuale danno anche solo ipoteticamente collegabile all'uso delle informazioni ivi contenute. TCH non si assume alcuna responsabilità dell’improprio uso che gli Utenti potrebbero fare delle informazioni riportate nei Siti. Inoltre, non essendo possibile garantire l'assenza di errori e l'assoluta correttezza delle informazioni divulgate, TCH non si assume la responsabilità per eventuali informazioni o notizie riportate sui Siti ove rivelatesi poi non corrette o non veritiere. Ad ogni modo TCH si impegna a correggere eventuali informazioni rivelatesi successivamente non corrette in seguito ad approfondita segnalazione, nei modi e nei tempi che TCH riterrà più opportuni.
• In nessun caso TCH risponde degli eventuali danni lamentati dagli Utenti per eventuali informazioni o contenuti del Sito che possono urtare la loro suscettibilità o offenderne la sensibilità.

Moderazione dei commenti

TCH offre la possibilità di commentare i suoi articoli e ricette per consentire agli utenti di partecipare alla discussione, ma si avvale della possibilità di moderare i commenti, con e senza immagini, prima che vengano pubblicati. I commenti verranno pubblicati dopo che è stata verificata la rispondenza dei loro contenuti ai criteri di pubblicazione in seguito indicati, inoltre talvolta alcuni articoli potranno essere chiusi ai commenti. Non verranno pubblicati i commenti che contengano, nel testo, nell'immagine o nel nome dell’autore:

indirizzi di siti web, soprattutto se non congrui o inviati a scopo promozionale; pubblicità di prodotti o servizi a fini di lucro; indirizzi email, numeri di telefono, indirizzi postali; codici per la partecipazione a giochi e concorsi; termini volgari o offensivi; attacchi o valutazioni personali nei confronti dell’autore dell’articolo, o di altri; contenuti estranei ai temi trattati nell’articolo (off topic) o in cui prevalgano discussioni tra i singoli commentatori; contenuti che sembrino poter offendere, provocare, umiliare qualcuno; contenuti razzisti, sessisti, omofobici o violenti; contenuti illegali o che predichino comportamenti illegali; contenuti che possano costituire un pericolo per gli altri; contenuti che la redazione giudichi irrilevanti o dispersivi rispetto ai temi trattati nell’articolo; opinioni personali dei commentatori perentorie, assiomatiche o prive di argomentazioni.

Inoltre non verranno pubblicati i commenti che provengano da utenze (nomi utenti o indirizzi IP) qualificabili come spam, oppure da cui giunga un elevato numero di commenti in un giorno.

Disposizioni specifiche applicabili ai Servizi relativi alla salute e agli elettrodomestici

• TCH mette a disposizione degli Utenti alcuni Servizi relativi alla salute, al benessere, alla nutrizione e alle diete, alle malattie, ai quali si applicano comunque le disposizioni previste dalle Condizioni Generali.
• Gli Utenti di questi Servizi sono altresì tenuti al rispetto dei termini e condizioni specificatamente applicabili a tali Servizi e qui di seguito riportati. Ove previsto, all’atto della registrazione o del primo utilizzo del Servizio, l’Utente dovrà dichiarare di aver preso visione dei termini e delle condizioni del Servizio:

I Servizi dedicati alla salute, al benessere, alla nutrizione e alle diete, alle malattie hanno carattere esclusivamente divulgativo e conoscitivo in riferimento all’argomento trattato. Tali informazioni non possono in alcun caso considerarsi alternative a o sostitutive di adeguato consulto medico specialistico. TCH declina ogni responsabilità per eventuali errori e/o inesattezze e/o fraintendimenti eventualmente ingenerati nell’Utente. TCH declina ogni responsabilità per le conseguenze dovute ad azioni personali dell’Utente in contrasto con lo spirito esclusivamente informativo dei Servizi e non può essere ritenuto responsabile per danni, diretti o indiretti, subiti. TCH non si assume alcuna responsabilità per inesattezze o errori sui programmi di cottura e/o preparazione o sui prodotti, anche basati su informazioni di terzi o su valutazioni dell’Utente generate dai Servizi. L'Utente deve leggere accuratamente tutte le informazioni fornite dai produttori di alimenti, e/o tutte le informazioni sulle confezioni e sulle etichette, compresi allergeni alimentari, valori nutrizionali e nutrienti contenuti, indicazioni salutari, richiami e ogni altra informazione relativa ai prodotti alimentari prima di consumare ogni tipologia di prodotto. L'Utente deve leggere anche tutte le informazioni fornite dai produttori di elettrodomestici su confezioni e libretti di istruzioni in merito all'utilizzo consapevole degli elettrodomestici stessi. L'Utente è responsabile di monitorare tutti gli elettrodomestici per un funzionamento sicuro, oltre che di verificare che gli alimenti siano stati conservati e cucinati a temperature sicure. Per informazioni aggiuntive su un elettrodomestico è necessario contattare il produttore. TCH non si assume alcuna responsabilità per il malfunzionamento degli elettrodomestici che causino danni alla proprietà o lesioni personali e/o per l'utilizzo del macchinario non conforme alle disposizioni del produttore.
